Now in a completed updated, revised and expanded second edition, Scott Hamilton's Practical Aviation Law provides complete, competent course for self-study or undergraduate study on how the legal system works with respect to aviation activities. With entertaining examples of aviation law in action, all of the recent changes to date in statutory and regulatory law are clarified, including international law. Practical Aviation Law is soundly recommended as a quick reference guide for aviation managers, private and professional aviators, flight cres, airline personnel, aircraft owners, air traffic controllers, air safety investigators, and the non-specialist general reader involved in aviation as a profession or hobby.

If you hold an FAA certificate -- you need this book! 5 out of 5 stars.

Several years ago, while attending Emery-Riddle Aeronautical University, this book was used as our textbook for Aviation Law. To this day, anytime I get on the subject of Aviation Law, I recommend this book to anyone who holds an FAA certificate. I'm a Maintenance Supervisor for a major airline and have suggested it to my employees who have found themselves in less than desirable situations involving enforcement actions. They always come back to me with the same comment; "I wish I had read this book before I got into trouble." Learn from their mistakes - read the book before you NEED the book. It's short and to the point, you won't be sorry!

Editorial Review:

Lists basic legal concepts of American aviation and how they can be applied to everyday aviation-related situations.

Editorial Review:

About the book--
The title, Aviation and the Law, is an intentional reflection upon the nature of law, for aviation law is but an integral part of all law. Therefore, this book starts from the beginning, to develop for the reader a basic understanding of the law, of its philosophy, and of its structure and due process, before addressing "aviation and the law" per se. The book is assembled in six major sections, the first of which gives definition to law, touches upon notions of justice, fairness, the underlying theories of law, and upon morality.
Section Two addresses criminal law as related to air transportation. Of primary concern are the issues of airport and airline security, air piracy, and other acts of criminal violence. Section Three, is an overview of civil (or tort) law in the field of aviation, focusing upon pertinent issues in their respective specialized areas, and supported by applicable case law. Section Four looks at airports and the role of government. Section Five deals with manufacturers' liability, the transfer of liability through insurance, and liability for accidents, including an overview of the government's responsibility to investigate aircraft accidents and to promote aviation safety. The final section is an introduction to international aviation law, including its historical development, the Warsaw System, bilateral governmental agreements, international competition, and exemplary court cases in this area.
As with previous editions, the purpose of this book is to provide sudents of aviation with a basic understanding of law, of the legal system, and of how the principles of law may be applied to the many aspects of air commerce and air transportation. Added to this latest edition are updates on the federal aviation security provisions since September 11, 2001, expansion in the area of international air law, as well as court cases of note decided since the last edition.

heavy, but good 4 out of 5 stars.
5 of 5 people found this review helpful.

This is a dense but ultimately rewarding introduction to the subject matter. Shaw's prose is at best elliptical; it's very easy to lose the forest for the trees in this book, particular given Shaw's tendency to explain in exhaustive detail the procedural workings of the various international and regional organizations. Although it sometimes reads like a very, very long grocery list, it is an essential reference book for anyone hoping to learn about public international law. Overall, it's a very thorough introduction to the subject matter, and is much more accessible the second and third times through. Complemented by an excellent index and supplementary materials.

nitpicking 5 out of 5 stars.

The remark about the Jay treaty convinced me. I immediately decided to buy this book; if an obvious typo (1974 instead of 1794) is the only objection that can made against this book, it must be great.

Editorial Review:

This updated edition of a popular textbook on international law includes a new chapter on International Environmental Law, and takes into account such recent significant developments as the Kuwait crisis, the responsibility of international organizations and the growth of international human rights law.

Great info on the history of aviation. Fast easy reading but not much on leglislation. The price of this book is criminal.

Excellent aviation books on the role of the government 5 out of 5 stars.

I'm working on my bachelor's degree and I found this to be one of the best books so far in all my courses. I read it from top to bottom. It provides excellent information on the history of American civil aviation, the FAA and airline deregulation. If you want to learn why civil aviation in the US is in such a sad state, then read this book!

Aviation and the Role of Government 3 out of 5 stars.

Give a good chronological review from the early days of aviation thru deregulation. More of a history of aviation then a review of legislation. Book did not get deep into early legislation but did devote a lot of chapters to regulation/deregulation. Overall material was informative but had a lot of personal views from author.

beat up book 1 out of 5 stars.

book badly beat up. highlighted extensively & much scribble in the margins.NOT WORTH $$, next time I will buy new.

History is good, typos are bad 2 out of 5 stars.

I recently had to use this book for a class on basic legislation relating to the aviation community. The history about the creation of the American aviation industry and regulation is interesting. On a whole the author doesn't dive too deep into it all, rather touches on major points in the history as needed for this basic introduction. The largest let down though is the self-check modules that are provided with the CD-ROM. There are numerous typos in both the book and supplied modules. It lead to confusion with a number of students on my class, because while trying to answer some of the modules the book had a different spelling or didn't even mention a subject that was being asked in the module.

Editorial Review:

A completely updated edition of a definitive survey of the peaceful settlement of disputes--a key aspect of international law and international relations. Many methods of handling such disputes have been developed, and this book explains what the relevant techniques and institutions are, how they work and when they are used. This new edition deals with many current developments, including the latest UN peace-keeping operations, the work of the WTO and of the International Tribunal for the Law of the Sea, and the latest case-law of the International Court of Justice.

Ignore Bush, Read This Book 5 out of 5 stars.
9 of 9 people found this review helpful.

Schabas succeeds fully in introducing the reader to the main features of the new International Criminal Court (ICC). His book is a model of legal exposition. He writes clearly, situates the ICC within the history of international law, relates the substantive law of the ICC to the jurisprudence of the Yugoslavia and Rwanda tribunals, and has interesting comments on the negotiating history that led to the ICC. After finishing Schabas' book, I was struck most of all by the care and thought that went into the design of the ICC, which conforms to the main lines of international law as the law has developed since 1945. The ICC is the world's best hope for bringing war criminals, human rights violators, and genocidalists to justice. It is a disgrace that the U.S. has tried to smother it in the cradle. (I am a U.S. State Department official.)

Editorial Review:

The International Criminal Court has ushered in a new era in the protection of human rights. Protecting against genocide, crimes against humanity and war crimes, the Court acts when national justice systems are unwilling or unable to do so. This third edition of this seminal text on the Court considers it in action: its initial rulings by the Pre-Trial Chambers and the Appeals Chamber and those cases it is prosecuting as well as those where it had decided not to proceed, such as Iraq. It also explores the law of the Court up to and including its ruling on a confirmation hearing. It addresses the political context of the court, such as the difficulties created by US opposition and the increasing recognition of the inevitability of the institution. Written by the leading expert in the field, this text is essential reading for any student of the Court and its workings.

Editorial Review:

In the summer of 1900, a zeppelin stayed aloft for a full eighteen minutes above Lake Constance and mankind found itself at the edge of a new world. Where many saw hope and the dawn of another era, one man saw a legal conundrum. Charles C. Moore, an obscure New York lawyer, began an inquiry that Stuart Banner returns to over a century later: in the age of airplanes, who can lay claim to the heavens?

The debate that ensued in the early twentieth century among lawyers, aviators, and the general public acknowledged the crucial challenge new technologies posed to traditional concepts of property. It hinged on the resolution of a host of broader legal issues being vigorously debated that pertained to the fine line between private and public property. To what extent did the Constitution allow the property rights of the nation’s landowners to be abridged? Where did the common law of property originate and how applicable was it to new technologies? Where in the skies could the boundaries between the power of the federal government and the authority of the states be traced?

Who Owns the Sky is the first book to tell this forgotten story of elusive property. A collection of curious tales questioning the ownership of airspace and a reconstruction of a truly novel moment in the history of American law, Banner’s book reminds us of the powerful and reciprocal relationship between technological innovation and the law—in the past as well as in the present.

A look at Building a Government After Invasion 5 out of 5 stars.
1 of 1 people found this review helpful.

This book comes at a particularily appropriate time. It has become very clear that the administrations of the major powers are operating at the limits of their capabilities in the area of peacemaking after conflict.

It seems that there was a string of what have to be considered real successes: Japan and Germany were out bitter enemies during World War II, yet after the war, what has to be considered enlightened supervision totally changed their governments to democracies reflecting the will of the people and making them good neighbors. South Korea is another example.

Then a series of bloodbaths occurred. Perhaps a hundred wars since then, with perhaps a hundred million people killed. Are we to allow more 'holocausts' in Haiti, Rwanda, and on and on.

This book is the report of law professors in U.S. law schools, but professors with experience on the ground in Haiti, Bosnia, Kosovo, East Timor, Liberia, Sierra Leone, and Iraq. ==These are not subjects that were unknown in our Government before the Iraq/Afthanistan invasions, but the level of the difficulty in establishing working governments certainly seems to have been minimized.

This book is an important contribution to thinking about the problems now being faced in Iraq.

Editorial Review:

This book looks at why it's so difficult to create 'the rule of law' in post-conflict societies such as Iraq and Afghanistan, and offers critical insights into how policy-makers and field-workers can improve future rule of law efforts. A must-read for policy-makers, field-workers, journalists and students trying to make sense of the international community's problems in Iraq and elsewhere, this book shows how a narrow focus on building institutions such as courts and legislatures misses the more complex cultural issues that affect societal commitment to the values associated with the rule of law. The authors place the rule of law in context, showing the interconnectedness between the rule of law and other post-conflict priorities, such as reestablishing security. The authors outline a pragmatic, synergistic approach to the rule of law which promises to reinvigorate debates about transitions to democracy and post-conflict reconstruction.
