Almost every country in the world has sophisticated systems to prevent banking crises. Yet such crises--and the massive financial and social damage they can cause--remain common throughout the world. Does deposit insurance encourage depositors and bankers to take excessive risks? Are banking regulations poorly designed? Or are banking regulators incompetent? Jean-Charles Rochet, one of the world's leading authorities on banking regulation, argues that the answer in each case is "no." In Why Are There So Many Banking Crises?, he makes the case that, although many banking crises are precipitated by financial deregulation and globalization, political interference often causes--and almost always exacerbates--banking crises. If, for example, political authorities are allowed to pressure banking regulators into bailing out banks that should be allowed to fail, then regulation will lack credibility and market discipline won't work. Only by insuring the independence of banking regulators, Rochet says, can market forces work and banking crises be prevented and minimized. In this important collection of essays, Rochet examines the causes of banking crises around the world in recent decades, focusing on the lender of last resort; prudential regulation and the management of risk; and solvency regulations. This book is an excellent source. Lovett traces the development of the current trends in banking and financial law, beginning with the First Bank of the U.S. The book also explains how banking law evolved with respect to the existing economic and political climate. Buy this book! There is no better synopsis of banking/financial law.

Needs to be much more nuts and boltsy, and less soft survey like. As an example, doesn't even define what makes a bank regulatable as a bank -- one of the most basic issues in banking law.

This casebook/textbook is one of the worst textbooks I have not had the pleasure to use during my legal education. The textbook made it through 14 editions yet is still filled errors, mistake, and tons of typo's. The subject organization is poor and the sections are not well seperated i.e. review questions in the middle of the sections, and then the section continues after the questions without an obvious break leaving you always wondering what section you are currently reading.

The reason it gets 2 stars rather than 1 is because at least it is comprehensive and full of material that is otherwise had to find, specifically about comparative economies such as the EU and Japan.

The conception of the field is original and complements existing texts written for finance or economics courses.

This book finds serious deficiencies with the by now extensive system of committees, organizations, rules, and guidelines that have emerged to govern and manage the international financial system. Concretely, it suggests that the existing framework, based on the supervision of individual financial institutions (especially banks), fails to take adequate account of the negative macroeconomic consequences that may flow from the financial failures of particular institutions. Even worse, emerging rules (such as the Basel II guidelines for minimum bank capital) may actually increase systemic fragility by making financial institutions more homogeneous in their behavior, leading to abrupt disruptions (financial crises) following periods of apparent but fragile stability. In making its central argument, the book offers informative coverage of the International Monetary Fund, the Basel committees on banking, the Asian financial crises, bankruptcy, the legal aspects of the system for settlement of payments, and many other relevant topics.

The book sets forth the economic rationale for international financial regulation and what role, if any, international regulation can play in effectively managing systemic risk while providing accountability to all affected nations. The book suggests that a particular type of global governance structure is necessary to have more efficient regulation of the international financial system.
