This is a great book! You need to read it whether you're already retired, thinking about retirement, or retiring in the far future. Lots of important info for all.

Pension plans in America no longer represent commitments that financially troubled companies will honor. Neither bankruptcy courts, nor Washington, nor unions have the clout to make them do so. The disposition of these plans is instead left to serve the needs of big investors. Often these investors are a company's best hope of restructuring after bankruptcy. Investors want a lean investment unburdened with financial promises to employees no longer on the payroll. Despite laws passed to discourage the termination of plans, the courts allow it, caving in to the forces garnered to reinvigorate a failing company. Unions are often compelled to choose between the financial welfare of retirees and jobs for active workers.

This book explains in shocking detail how terminating the pension plan became a knee-jerk strategy for bankrupt companies that hope to attract big investors to help them reorganize.

I use this book in teaching a Bankruptcy class to California paralegal students. It is an excellent introduction to the bankruptcy system, and includes discussions of both consumer and business bankruptcies (with a definite emphasis on the consumer side). I expecially appreciate the thorough treatment of the BAPA (laws that changed in October 2005).

The potential failure of a large bank presents vexing questions for policy-makers. It poses significant risks to other financial institutions; to the financial system as a whole; and possibly to the economic and social order. Because of such fears; policymakers in many countries - developed and less developed, democratic and autocratic - respond by protecting bank creditors from all or some of the losses they otherwise would face. Failing banks are labeled "too big to fail" (or TBTF). This book examines the issues surrounding TBTF, explaining why it is a problem and discussing ways of dealing with it more effectively. Gary Stern and Ron Feldman, officers with the Federal Reserve, warn that not enough has been done to reduce creditors' expectations of TBTF protection. Many of the existing pledges and policies meant to convince creditors that they will bear market loses when large banks fail are not credible, resulting in significant net costs to the economy. The authors recommend that policymakers enact a series of reforms to reduce expectations of bailouts when large banks fail.

This review is excellent. Epstein's approach in this Bankruptcy review is to teach the essentials to write a good final exam.

I drive a lot. That's when and why I use these CD's. I listen to them in the beginning of the semester to get the "lay of the land" for the course. Then I listen to them again in the middle of the semester to keep perspective about where we've been and where we're going. Finally, I listen to them a third time at the end of the semester, when everything is review. I have found this to be an EXCELLENT strategy to supplement all of my reading+writing review. This is a constructive use of my driving time, and well worth the expense.

I was really disappointed with this book, particularly given that it was written by seasoned bankruptcy experts. The book is very skinny on content - it spends about 30 pages on bankruptcy law and its procedures, a few on case studies that are superficial/poorly written and several on bond analysis, and standard research tools that are well-known to a person with basic financial knowledge, ie the sort of people who would be interested in something relatively exotic as Bankruptcy Investing. The few useful pages that there are are marred by poor writing, and a complete absence of analytical frameworks that stay with the reader.

Bankruptcy is a complex topic and there is a need for a book of the sort Branch and Ray have attempted. However, this is most certainly not that book.

Great introduction and overview of the world of distressed and bankruptcy investing. The authors managed to synthesize a very complicated subject into an easy-to-read and understandible book. Of course no one book can cover the entire subject in detail, but this one comes amazingly close. Highly recommended.
