Editorial Review:

In 1982 Johns-Manville, a major asbestos manufacturer, declares itself insolvent to avoid paying claims resulting from exposure to its products. A year later, Continental Airlines, one of the top ten carriers in the United States, claims a deficit when the union resists plans to cut labor costs. Later still, oil powerhouse Texaco cries broke rather than pay damages resulting from a courtroom defeat by archrival Pennzoil.
Bankruptcy, once a term that sent shudders up a manager's spine, has now become a potent weapon in the corporate arsenal. In his timely and challenging study, Kevin Delaney explores this profound change in our legal landscape, where corporations with billions of dollars in assets employ bankruptcy to achieve specific political and organizational objectives. As a consequence, bankruptcy court is rapidly becoming an arena in which crucial social issues are resolved: How and when will people dying of asbestos poisoning be compensated? Can companies unilaterally break legally negotiated labor contracts? What are the ethical and legal rules of the corporate takeover game?
In probing the Chapter 11 bankruptcies of Johns-Manville, Frank Lorenzo's Continental Airlines, and Texaco, Delaney shows not only that bankruptcy is pursued by managers more and more as a strategy, but that it is becoming accepted by the business community as a viable option, and not just a last-ditch solution.
This searing exposé of current corporate practices will incite debate among corporate executives, lawyers, legislators, and policy makers.

Great read with bonuses, buy this and not the high dollar package! 5 out of 5 stars.
5 of 5 people found this review helpful.

Note you CAN do the credit repair yourself, the author does give quite a bit to think about including the future of buying real estate w/ your continuing good credit to build security to wealth.

DON'T bother w/ the full package the author tries to sell you. Most everything you will need is in this book. Also consider form letters which are edited. He doesn't provide that (see how to make your credit sparkle) but does offer insights. A standard form letter edited will do or a basic credit repair software where all you have to do is enter info and print.

All in all a good book but don't let the hype and overkill of the author move you to spend hundreds of dollars on seminars to full packages when this is all that's really needed... just say no to the infomercial!

Editorial Review:

Introduction to Bankruptcy Law, fifth edition, is a perfect reference for practicing paralegals and attorneys as well as for paralegal courses in bankruptcy law. This new edition corresponds to the changes in bankruptcy law after enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). Material in this edition includes changes in the bankruptcy code and practice, new and revised official and procedural bankruptcy forms, revised bankruptcy rules, and bankruptcy cases that detail the case from initiation of the attorney/client relationship through the closing of the case. The book also includes new flow charts for each type of bankruptcy filing that emphasize the two tracks of bankruptcy; the administration of the bankruptcy estate and the debtor s desire to receive a discharge from as many debts as possible. Other key features are a brief history of bankruptcy law, research aids, alternatives to bankruptcy, a discussion of the role of the various parties involved in the bankruptcy process, and an overview concerning eligibility and the selection of the appropriate bankruptcy chapter under which the case should be filed. The book retains its step-by-step approach to each type of bankruptcy filing so the bankruptcy process is clear and understandable to the reader. Greater emphasis is placed on the paralegal s role in the fact gathering process and the interface with clients, and the concept-example-problem format of provides the opportunity for lively discussion.

Editorial Review:

The thousands of mergers, acquisitions, and start-ups that have characterized the past ten years of business have created an increasing number of corporations in financial trouble: specifically, a shortage of venture capital or quick cash. Consequently, bankruptcy protection is now viewed as a strategic move to protect corporations from their creditors and allow them to reorganize. Bankruptcy and Insolvency Taxation, Third Edition provides the answers to the questions financial managers will have on the tax aspects of the "bankruptcy strategy."

More engaging than my teacher. 5 out of 5 stars.
3 of 3 people found this review helpful.

As a student, this was probably the best textbook I've ever used. The authors presented the material in an engaging way that brings out the relevance, controversy, and centrality of creditor/debtor/bankruptcy law in the life of almost every American. I never thought I'd say this about a textbook, but it's a great read.

One of the worst casebooks 2 out of 5 stars.

This is one of the worst casebooks ever written, although it wont stop the sales because most students do not have a choice of textbooks. The book is poorly edited and leaves out crucial pieces of information (such as which statute is relevant). The book is also in an order that is not conducive to learning the material.

We worked it out. 2 out of 5 stars.

The book was not in the proposed condition, this is a negative for me. But we were able to work it out and I am satisfied with the result.
