We are all familiar with the image of the immensely clever judge who discerns the best rule of common law for the case at hand. According to U.S. Supreme Court Justice Antonin Scalia, a judge like this can maneuver through earlier cases to achieve the desired aim--"distinguishing one prior case on his left, straight-arming another one on his right, high-stepping away from another precedent about to tackle him from the rear, until (bravo!) he reaches the goal--good law." But is this common-law mindset, which is appropriate in its place, suitable also in statutory and constitutional interpretation? In a witty and trenchant essay, Justice Scalia answers this question with a resounding negative.

In exploring the neglected art of statutory interpretation, Scalia urges that judges resist the temptation to use legislative intention and legislative history. In his view, it is incompatible with democratic government to allow the meaning of a statute to be determined by what the judges think the lawgivers meant rather than by what the legislature actually promulgated. Eschewing the judicial lawmaking that is the essence of common law, judges should interpret statutes and regulations by focusing on the text itself. Scalia then extends this principle to constitutional law. He proposes that we abandon the notion of an everchanging Constitution and pay attention to the Constitution's original meaning. Although not subscribing to the "strict constructionism" that would prevent applying the Constitution to modern circumstances, Scalia emphatically rejects the idea that judges can properly "smuggle" in new rights or deny old rights by using the Due Process Clause, for instance. In fact, such judicial discretion might lead to the destruction of the Bill of Rights if a majority of the judges ever wished to reach that most undesirable of goals.

This essay is followed by four commentaries by Professors Gordon Wood, Laurence Tribe, Mary Ann Glendon, and Ronald Dworkin, who engage Justice Scalia's ideas about judicial interpretation from varying standpoints.

When studying for Conflicts--one of the hardest exams in my law school--I used this book. It was great! It had everything I needed to know...and more. It was also easily organized and easy to follow. It really laid everything out and had some great easy to memorize checklists.

Though long, this outline helped relieve my fears. 4 out of 5 stars.

I went to the law school where this author used to be dean. She didn't teach conflict of laws (she taught marital property) and the students who did take conflict of laws said it was incredibly hard. Conflict of laws is basically civil procedure to the second power. I am still not convinced that I would be able to site a conflicts issue in a civ. pro. question. Nevertheless, this Gilberts was helpful. It's long, like the Gilberts for property, torts, and other multistate bar subjects. However, its length is due to the fact that it covers civ. pro. concepts that you will need to understand. This Gilberts has a lot of charts that will help you digest the material. It's most helpful when the charts come at the beginning of the chapter, but unfortunately most charts don't appear until the end. This Gilberts mentions DOMA (the Defense of Marriage Act) and it suggests how big that issue will be in the courts in the future. This commercial outline was quite helpful.

Make it this one. This is hands down the best book on the topic. It beautifully (sometimes amusingly) goes over each argument for and against the idea of not just decriminalizing but legalizing consensual crimes.

Its a very easy read, with large font and interesting quotes from surprisingly supportive historical figures such as John Adams, Reagan advisors, bush advisors, and George Washington.

Peter's cannabis activism, as evident by Ain't Nobody's Business, was a large part of the government's rationale for killing him: "How dare anyone write a book claiming the drug war is immoral and ineffectual, and that it mercilessly destroys innocent lives."

Peter was a casualty of that war, I'm increasingly convinced not as collateral damage but as a intentional target of the enemy.

Peter never stooped to the brutality of his tormentors; he held to the end that these officials who imposed and applied such draconian restrictions while Peter awaited sentencing were only well-meaning pawns in a silly policy. "Father forgive them for they know not what they do." Even though John Stossel managed to air a positive 20/20 segment on Peter's plight shortly before Peter died, virtually no one in the controlled media elevated the story to where it belongs: the saga of Peter McWilliams, late-20th-century Ghandi for personal liberty.

A fresh perspective on the Texas Rangers 5 out of 5 stars.

Dr. Mike Collins offers the reader a first rate scholarly treatment of the subject matter. In this book the reader is transported back to a time in Texas history where myth and legand are fleshed out in a whole new light. The reader will have an accurate account of the Rangers and Regulars for the first time. The Rangers have often been portrayed in lore and film as tall men in the saddle wearing white hats coming to the rescue of the praire family being threated by the Indians or rogue Mexican bandits and outlaws. Not the case all the time! Dr. Collins tells the reader what really occurred back then.

In the book you will find some very rare, never before published photos of men like John S."Rip" Ford and Juan N. Cortina the "Red Robber" who were Texas legends. The reader will also gain a new perspective on the Anglo-Texans and how different they are betrayed in 'Texas Devils' compared to other works like Walter Prescott Webb's "The Texas Rangers: A Century of Frontier Defence" which by many is considered the definitive work on the subject. Dr. Collins' new scholarship on the Anglo-Texans alone will undoubiedly raise some discussion critcism in the academic world of Texas history.

Rather than bringing peace to the region, the Texas Rangers contributed to the violence and were often brutal in their injustices against Spanish-speaking inhabitants, who dubbed them los diablos Tejanos - the Texas devils.

In revealing a barbaric code of conduct on the Rio Grande frontier, Collins shows that much of the Ranger Myth doesn't hold up to close historical scrutiny.

My book is a brand new 3rd edition Hornbook. I don't know who wrote the review for the second (the info is good) but the third is newer, is hardback, and doesn't have a disk.
