Editorial Review:

How can otherwise normal, moral persons - as citizens, voters, and jurors - participate in a process that is designed to take the life of another? In DEATH BY DESIGN, research psychologist Craig Haney argues that capital punishment, and particularly the sequence of events that lead to death sentencing itself, is maintained through a complex and elaborate social psychological system that distances and disengages us from the true nature of the task. Relying heavily on his own research and that of other social scientists, Haney suggests that these social psychological forces enable persons to engage in behavior from which many of them otherwise would refrain. However, by facilitating death sentencing in these ways, this inter-related set of social psychological forces also undermines the reliability and authenticity of the process, and compromises the fairness of its outcomes. Because these social psychological forces are systemic in nature - built into the very system of death sentencing itself - Haney concludes by suggesting a number of inter-locking reforms, derived directly from empirical research on capital punishment, that are needed to increase the fairness and reliability of the process.
The historic and ongoing public debate over the death penalty takes place not only in courtrooms, but also in classrooms, offices, and living rooms. This timely book offers stimulating insights into capital punishment for professionals and students working in psychology, law, criminology, sociology, and cultural area studies. As capital punishment receives continued attention in the media, it is also a necessary and provocative guide that empowers all readers to come to their own conclusions about the death penalty.

Editorial Review:

As individuals travel across borders, societies have become more and more pluralistic. The result of increased migration is the interaction among cultural communities and inevitably clashes between state law and customary law. These cultural conflicts have given rise to a new multicultural jurisprudence. In this volume, scholars grapple with the immense challenges judges are currently experiencing everywhere. To what the extent can and should courts accommodate litigants' request by taking their cultural backgrounds into account? This collection brings together powerful examples of the cultural defence in many countries in Western Europe, North America, and elsewhere. It shows the ubiquity of this defence, contrary to the mistaken impression that it has been invoked principally in the United States. This book makes the case for undertaking studies of the use of the cultural defence in jurisdictions all over the world where this has not been previously documented. Many of the essays concentrate on criminal cases including homicide in the context of honour crimes, provocation based on 'loss of face', or witchcraft killings. Some deal with other areas of law such as asylum jurisprudence, family law, and housing policy. They show in concrete cases how cultural claims have arisen and how legal systems wrestle with these arguments. It is clear that judges have had considerable difficulty handling many of the cultural claims. The authors demonstrate persuasively the need to reconsider the proper use of cultural evidence in legal proceedings. Those interested in the ways in which expertise influences the disposition of cases will find this book compelling. This book contains controversial and critical essays which question the existence of a universal approach to the theory of law. It will be a required reading for scholars and students of law and society, and globalisation.

Excellent primer on theory, more historical than legal. 5 out of 5 stars.
10 of 10 people found this review helpful.

This is a fabulous book. It begins with early concepts from ancient Greece, lays out the fundamental differences between "natural law" and "the law of the real world," then extends the history of legalistic ideas through the Roman epoc, middle ages, etc. The book identifies the bases of difference between the legal systems of the west and those of communist states, e.g., common law and code law vs. Marxist law. It fully describes the influence of Christianity on western legal thinking. There are "plots" and "sub-plots" in this book that are absolutely fascinating. Finally, it is deliciously written; for those who truely appreciate the english language.

Editorial Review:

This unique publication outlines the development of legal theory from pre-Roman times through the twentieth century. It relates the evolution of legal theory to parallel developments in political theory and history. This work also discusses the relevant contemporary events in politics, economics, and religion. Each chapter begins with a synopsis of related historical background for the period, going on to discuss how these events are related to political and legal theory as well as how they become an influence on one another. Avoiding the conventional approach of "traditions" or "schools" of thought, this work aims to anchor legal theory to contemporary general history.

Editorial Review:

There are three things that people will die for — their faith, their freedom, and their family. This volume studies all three, and the interactions among them in the Western tradition and today. Retrieving and reconstructing a wealth of material from the earliest Hebrew and Greek texts of the West to the latest machinations of the Supreme Court, John Witte explores the legal and theological foundations of authority and liberty, equality and dignity, rights and duties, marriage and family, crime and punishment, and similar topics. This volume is a lucid scholarly introduction to the burgeoning field of law and religion and a learned historical inquiry into the weightier matters of the law.

Scholars of law, theology, history, ethics, marriage, politics, American studies, and human rights will find this volume an invaluable classroom text, commuter companion, and armchair paperback.

A definite must read for students interested in law! 4 out of 5 stars.

Jurisprudence can be an intimidating subject. This book will help you understand complex legal issues, whether you are a law student or an individual concerned with legal philosophy. This book is comparable to the Real Property Nutshell book. I read both books prior to taking my Property and Jurisprudence classes in law school. As a result, I was much better prepared for the semester. Without a doubt, I recommend reading this book before you take you Jurisprudence, which is most likely a required class for your law school.

Editorial Review:

Examines the central questions about the nature of law. What is law? How is it defined? What are the essential aspects? Divided into three sections, this authoritative text investigates the various theories of law—metaphysical-rational epistemology, idealistic epistemology, and empiricist epistemology.

Editorial Review:

Smith's "Lectures on Jurisprudence", originally delivered at Glasgow University in 1762-1763, presents his "theory of the rules by which civil government ought to be directed". Building on his "Theory of Moral Sentiments", Smith argues that the state must act as an impartial spectator, judging when an individual has been injured, Thus, regulations concerning trade, commerce, and production must be crafted so as to encourage rather than interfere with other productive capacities.

I like the way he thinks 5 out of 5 stars.
10 of 10 people found this review helpful.

I'm turning into quite a fan of Leo Katz. I was so impressed by his _Bad Acts and Guilty Minds_ that I picked this one up almost at once. And it's just as good.

This time around, Katz's plan is to deal with what he calls "three related mysteries": the moral problem of "avoision" (i.e., what counts as morally bad evasion and what merely as legitimate avoidance); the moral nature of e.g. blackmail and insider trading (i.e., what, if anything, justifies our all but universal moral intuitions that these and other similar acts are genuinely wrong); and the problem of "undeserved glory" (and what's wrong with appropriating someone else's fame).

I won't try to spell out Katz's examples and arguments under each of these headings, for I could not do so if I tried: his discussions are very well organized, but they pass from one subtopic to another with such rapidity and ease that I would have a hard time deciding just what to select. In general I shall say only that even where I disagree with him (as I sometimes do), his lively and provocative analysis is a sheer joy to read.

His most prominent theme is also one of which I heartily approve. There are some lawyers, philosophers, and especially economists who think it is possible to be both a libertarian and a utilitarian. Katz forcefully disagrees (as do I). And one purpose of this volume is to hammer that point home.

Himself apparently a libertarian, Katz argues repeatedly and at length that libertarianism requires a deontological foundation; utilitarianism is simply inadequate in every respect. Along the way he also mounts a striking _deontological_ defense of the role of the attorney (in helping clients to avoid malignant moral outrages by "capitalizing on the deontological properties of legal rules," p. 131; you'll have to read the book to find out just what this means). And in one brief passage that one could wish were longer, he follows Amartya Sen to a striking conclusion: libertarianism is _also_ incompatible with complete freedom of contract. As in his earlier book, Katz's own outlook seems to be a sort of self-critical intuitionism along the lines of Judith Jarvis Thomson (whose "trolley problem" also gets a further workout here).

I wrote in my review of Katz's previous book that it was all but unique. I am happy to say that isn't entirely so; this book is a lot like it. Highly recommended.

Editorial Review:

One of the things that attracts some people to lawyers and repels the rest of us is their ability to see and create loopholes. If the law is an ass, it is a very clever one. This book, by a University of Pennsylvania law professor, investigates the loophole phenomenon to a fare-thee-well. Want to use damaging information about a competitor to keep her away from an interview for a job you're both vying for, but don't want to violate the extortion statutes? Then see p. 2. Mad enough at your son to want to burn his house down with him in it but don't want to get convicted of first-degree murder? The recipe for that is on p. 38. Katz serves up a rich variety of examples and their variations to arrive at a general theory of what lawyers are doing when they -- legally -- walk their clients around a law. Truth be told though, the examples are a lot more compelling than the theory.

Editorial Review:

Dispelling current myths regarding organized crime, Lyman and Potter’s fourth edition reveals a truer picture of organized crime and criminal activity today. Providing scholarly treatment and a social perspective, the authors explore the concept of organized crime, the historical foundation for its evolution and development, and the current status of criminal groups in today’s society. Offering timely and respected research, this edition includes a thorough examination of drug trafficking, new sections on emerging organized crime groups, updated case studies, more coverage international groups, updated statistics, graphics and more! Presents a broad view of organized crime that incorporates more than just ethnically- driven, pop-culture stereotypes. Incorporates two parallel themes—organized crime consists of many different groups and corrupt individuals in public office, business etc., contribute to the continuation of the problem. Uses thematic questions (What is organized crime? Is there really a Mafia? Is terrorism organized crime? Do political machines still exist?) to promote higher-order thinking skills and a critical examination of the topic. Synthesizes volumes of historical data and archives to present the most salient aspects of the organized crime problem. References information and reports generated by the Federal Bureau of Investigation, the Pennsylvania Crime Commission, the National Institute of Justice, the Bureau of Justice Statistics and well-known researchers in the field. Law enforcement professionals and those interested in a scholarly treatment and a social perspective of organized crime.

Editorial Review:

Taking a psychological orientation, this book examines the causes, prevention, and intervention of juvenile offending from a contemporary developmental perspective. It looks at how the juvenile offender is influenced by multiple systems within the social environment, issues of resilience and human strength, and strategies for prevention, intervention and treatment. Multicultural perspectives are considered throughout and this edition features more on developmental research, juvenile gangs, and child and adolescent psychopathy. Photos, graphs, tables, and figuresare integrated throughout the book for a visual, easy learning experience.
