Great intro to the Catholic View of the Natural Law 3 out of 5 stars.

This book is a great introduction to how the Natural Law fits into Catholic philosophy.

The book is very well organized, with each question being independent of the other as much as possible without sacrificing relevance. The writing style is very good, the chronological orders of the questions are great, and the questions are common. Overall the book was great reading and the answers were good. I especially enjoyed Prof. Rice's talks about how the Catholic Church views man (as a relational creature), views the family in relation to the state, and her sexual ethics.

With all that said, there are some negatives that bring the book down from five stars to 3.5 stars. One negative being that this book was made more for the already Catholic who would like to know how the Natural Law fits into Catholic theology. It is much less a defense and understanding of the Natural law than it is an understanding of how the Natural law fits into Catholic philosophy, and certain Catholic teachings with regard to the natural law. When I received the book, I was looking more for a general understanding of the Natural Law, with emphasis on different schools of thought on the subject, and where they differ. I was also looking for systematic ways of applying the Natural Law in our everyday life. This was not given in much detail at all. The author relied too heavily on what the Catholic Church already teaches on certain topics, than on how I can arrive to that conclusion on my own reason. I would like to have seen the emphasis reversed. Because of the books strong reliance on Catholic teachings and presuppositions, anyone who is investigating the Natural Law as an alternative to the liberalism of today, and who doesn't have an already preconceived respect for the Catholic Church will not have a lot to gain from this book.

Another, and more important, negative is some sections are only introductory answers to very complex issues. Sometimes I would have liked the author to give other areas less attention and maybe concentrate more on more prevalent areas, especially areas where there is much more confusion and the Catholic Churches reasoning so strong. Areas like Contraception, Abortion, and even surrogate motherhood could have received more attention. Or at least recommended great books to read more on the subject. Authors like, Janet Smith, Peter Kreeft, and Fracis Beckwith each provide outstanding additions, and much more depth to many of the topics covered in this book. Yet Charles Rice does not recommend any of them. Now I can understand his desire to keep the answers general and succinct. I realize there are far too many important topics in this book to give each answer its due time. I just often wonder if a little more space for certain loaded questions would have been better.

I would just like to end with, if you are expecting how I characterized the book on my first comment, than this book is right for you. I couldn't recommend it more.

French provides the first detailed examination of the Tibetan legal systyem based on research carried out in India (Dharamsala) where she worked closely with a former Tibetan official. Based on his own personal accounts of life as an official in central Tibet prior to the occupation by China and law codes issued by the Ganden Phodrang government of the Dalai Lamas and earlier works she provides an interesting, indeed fascinating insight into the operation of law and legal processes in a Buddhist state. Using ancedotal evidence and the law codes she divides the book in to two sections. The first outines legal and Buddhist concepts which permeate the second part whcih uses a wide range of "ethnographic" ancedotes to show how religious ideals and legal practices were interlinked.

The writing is lucid and although an excellent work for those interested in Tibet academically, it is an accessible work which contains many fascinating details. Perhaps it is unfortunate that it appears to present Tibet as a homogenous society under the hegemoci rule of the Lhasa government( which it was not), nor does she really consider law and legal processes among non-Buddhist in Tibet, notably she is silent on Moslems and the Bon-po and perhaps this reflects not only the desire to present the Buddhist aspect of law in Tibet but the prejudices of her own principal informant. Her presentation of Buddhism also perhaps gives the reader the impression of it being a monolithic and uniform religion and in particular seems to emphasis the Gelugpa tradition within Tibetan Buddhism. What of the other traditions and in particular non-Buddhist practices? On a more academic note it would be more useful to scholars to have proper references to the sections of the law codes cited that to her own note books! Of course Dr French is producing transaltions of these works which will hopeful deal with this minor, but important comment.

Overall, an important first step towards developing our understanding and appreciation for the interconnection between religious doctrine and law in Tibet. A real labor of love by the author and one for which she must be highly commended.

The Golden Yoke causes us to rethink American legal culture. The legal cosmology of Buddhist Tibet brings into question both the autonomous framework underlying this system and most of the presumptions we have about the very nature of law, from precedent and res judicata to rule formation and closure.

This is a translation of a 12th-century Sanskrit legal text, with the original text. The Dayabhaga was one of the most important texts in the history of Indian law. The text, fairly late and inspiring little attention, is important because the British elevated it to such prominence in their new colony in the early 19th century. It was known as the authority on inheritance and significant aspects of family law for the eastern Indian region. As the author makes plain, in pre-Colonial India, since the dawn of time, there was no "separation of church and state" -- secular law and religious law were one and the same. This book answers many of the questions you always had an about the true meaning of karma, dharma, and justice in Indian culture. It analyzes India's ancient legal literature, explaning myths and rituals that helped guide generation after generation. It illuminates the ancient laws of Manu, describing them as a conscious integration of legal material within a Vedic moral viewpoint. Scholarly and thorough!
