Nice book to understand the system 4 out of 5 stars.

The book is really organized very well and provides a lot of detailed technicalities that one can make use of to win the case. In fact, I was surprised that we can use these technicalities to great effect in the court, especially if you get a fair minded judge in the court.


The only criticism I have is on the last chapter of the book. In the last chapter, the author talks about the corruption in the entire traffic court system. He concludes that there is very little that one can do to win a case in the court, since Judges and Cops go hand in hand. Well, if this is really true, whats the point of writing the book then?

In conclusion, the book is great when it comes to understanding how the system works. At the end of the day, its just a book. Do not expect the book to win the case for you. You WOULD have to do that for yourself.

This power of the judges is known as “judicial review,” and it often seems the central feature of American constitutional law. The authority and scope of this power, however, have long remained unclear, and because historical accounts have tended to suggest that the judges themselves largely developed judicial review, the history has given credence to the view that judges enjoy considerable discretion over the extent and exercise of this power.

    Law and Judicial Duty presents a very different history and a very different conception of the power of the judges. Drawing upon previously unexplored evidence, Philip Hamburger reveals the familiar notion of judicial review to be largely an illusion produced by modern assumptions, and he shows that what today is called “judicial review” was once understood more simply as part of the duty of judges to decide in accord with the law of the land.     This is a broad survey of many aspects of US court history and judging, assembled from a diverse array of sources, although quite a lot of the authors are contemporary judges. If you have a running interest in the law, this is quite readable even for non-lawyers. Most of the authors are actually remarkably lucid and a pleasure to read. Other volumes that might be of interest for you include Cardozo's "selected writings" (on judging and law; 1920s) and Neumann's book on legal reasoning for law students (or afficionados).

    This is a textbook of the juvenile dependency system that reads like a page-turner novel. I was unable to put it down for 2 days. The authors' treatment of their material is even-handed and true-to-life. I have worked for the past 4 years as a Court-Appointed Special Advocate and Guardian Ad Litem for these children in my local juvenile court and the cases featured in the book closely mirror the actual cases I've seen over and over again in the courts. The book raises problems in the system to which there are no easy answers, and the authors don't attempt to offer any simplistic solutions: What does the system do with severely emotionally disturbed kids who blow through one placement after another? How do you know when to give up on parents and terminate parental rights? Do you wait until the child's crucial childhood years are mostly over, waiting for the parents to get their act together? How do we place children in good homes when there is such a shortage of foster and adoptive families? I urge anyone interested to get involved with the system as a volunteer. There are over 700 advocate programs around the country and the minimum time commitment is only 12 hours a month.

    Please note that there is both a tenth edition and an UPDATED tenth edition. They're virtually identical, but the updated edition has materials related to the Crawford case addressing the confrontation clause.

    Almost no notes or comments on compiled materials in the book. It is difficult to find keys to understand materials from this book without assistance from teachers or study guides. The materials themselves are instructive and interesting. The book becomes voluminous due to the appended rules and their notes. If one has a separate rule book, he/she has to spend more for the unnecessary appendix attached to this book.

    In August 1955, the mutilated body of Emmett Till—a fourteen-year-old black Chicago youth—was pulled from Mississippi's Tallahatchie River. Abducted, severely beaten, and finally thrown into the river with a weight fastened around his neck with barbed wire, Till, an eighth-grader, was killed for allegedly whistling at a white woman. The nation was horrified by Till's death. When the all-white, all-male jury hastily acquitted the two white defendants, the outcry reached a frenzied pitch—spurring a fury that would prove critical in the mobilization of black resistance to white racism in the Deep South.

    In this sensitive inquiry, historian Stephen J.     I did enjoy this book and found vaious helpful and useful advice for testifying. However, the entire book is written from a psychologist's point of view and virtually all the examples and stories are from psychologist's testifying in court.

    Being in the computer profession I had to relate how my experience would apply to the maxims and examples provided in this book. This was easy for some maxims, difficult for others, while some maxims and examples totally did not apply at all.

    This is Brodsky's first book on Expert Witnessing and is now 6+ years old. It remains one of the best primers on what to expect, particularly for the psychologist, when working in a forensic environment. It is easy to read, has great stories, offers good citations, and covers a deceptively wide range of central issues for anyone wanting to be better prepared for work with lawyers and the courts. Each "chapter" is 2-3 pages in length, which makes them easy to read and digest in brief periods as each "chapter" is independent and stands alone well. I have read all three of the books in this "series" by Brodsky and continue to view this one as the best of the three.

    Stanley Brodsky's Testifying in Court stands out because it deals with mastering the psychological and emotional experience of being in court. The emphasis is not on laws and rules of evidence or procedure. The book leads the reader step by step through the demands and pitfalls of courtroom testimony and questioning. Humorous illustrations and witty observations are used to put the prospective witness at ease. 7/91.
