The "Judicial Reports/Recueils judiciaires of the International Criminal Tribunal for the former Yugoslavia (ICTY) comprise (in English and French) all public Indictments, as well as Decisions and Judgements issued in a given year. It will give lawyers, scholars, students and the general public convenient access to the historic work of the ICTY, which was established pursuant to United Nations Security Council Resolution 827 in 1993 to try individuals accused of serious violations of international humanitarian law committed in the territory of the former Yugoslavia since 1991. The "Judicial Reports are organized chronologically by case. Within each case, one will find the text of Indictments, reviews of Indictments and, where applicable, deferral requests. Thereafter the text of a public review of the Indictment pursuant to Rule 61 may follow. The publication also contains the texts of the Orders, Decisions and Judgements, as well as the separate and/or dissenting opinions that may accompany a given Trial Chamber or Appeals Chamber ruling. The "Judicial Reports will contribute to a greater knowledge of the judicial activities of the ICTY. Various annexes, such as a table of cases, a list of Indictments and Indictees, a table of Deferrals and of Rule 61 Procedures, as well as a table of references, facilitates the use of these volumes. Les "Judicial Reports/Recueils judiciaires du Tribunal pinal international pour l'ex-Yougoslavie (TPIY) contiennent (aussi bien en frangais qu'en anglais) tous les Actes d'accusation publics, ainsi que les Dicisions, Arrjts et Judgements, rendus au cours d'une annie donnie. Ils permettront aux praticiens du droit, universitaires et itudiants, ainsi qu'au grand public, d'accider aisiment aux travaux historiques du TPIY, lequel est habiliti, en vertu de la Risolution 827 du Conseil de Sicuriti des Nations Unies (1993) juger les personnes prisumies responsables de violations graves du droit international humanitaire commises sur le territoire de l'ex- Yougoslavie depuis 1991. Author Richard Chang maintains that there is no factual evidence to support the Japanese contention that the Western consular tribunals of the nineteenth century were partial to Westerners and prejudiced against Japanese, and, consequently, seldom rendered equal justice. He ascertained how many of the more than 3,500 mixed cases were decided prejudicially against Japanese litigants. Chang's careful treatment of the five most celebrated mixed cases makes it possible to see for the first time how international law operated through consular jurisdiction and how the Japanese were trying to protect national interests within a justice system dependent on Western jurists. The book also provides the first overview of the extra-territorial agreements between Japan and the Western powers with which it traded during this period.

A striking feature of the proceedings in the majority of cases before the International Court of justice since 1971 has been the absence from the courtroom of the state against which the proceedings have been brought. The various recent cases in which the possibility of 'non-appearance' has been resorted to by respondent states have given rise to a number of delicate problems of procedural law: and the phenomenon itself has caused disquiet. In this book, the first general study of the question to appear for over twenty years, the phenomenon is studied in the light of the statute and of the fundamental concepts and principles of international judicial procedure. The author, as an official of the court for over fifteen years, is particularly well qualified to expound a question of procedural law which, although apparently small in compass, is far-reaching in its implications for the future of international judicial settlement.
