This second volume of the Canadian State Trials series focuses on the largest state security crisis in 19th century Canada: the rebellions of 1837-1838 and associated patriot invasions in Upper and Lower Canada (Ontario and Québec). Historians have long debated the causes and implications of the rebellions, but until now have done remarkably little work on the legal aspects of the insurrections and their aftermath. Given that over 350 men were tried for treason or equivalent offences in connection with the rebellions, this volume is long overdue.

The essays collected here, written by prominent Canadian historians, legal scholars, and archivists, break new ground in the existing historiography of the rebellions by presenting the first comprehensive examination of the legal dimensions of the crises. In addition to examining trials and court martial proceedings, the essays examine their political, social, and comparative contexts, including the passage of emergency legislation and executive supervision of legal responses, the treatment of women, and the plight of political convicts transported to the Australian penal colonies. Canadian State Trials, Volume Two contributes significantly to the ongoing reassessment of the rebellion period.

This collection of essays by prominent Canadian political scientists and philosophers examines why the Charlottetown Accord failed to resolve Canada's constitutional problems and explains the design and fate of the Accord as reflected in the theories and political forces that framed it. Canada's fifth effort at "mega-constitutional politics" was a period of popular discussion and leadership negotiation, that ran from the defeat in 1990 of the Meech Lake Accord through to the Charlottetown Accord and the referendum of 26 October 1992. "Constitutional Predicament" explores the referendum in relation to the democratic process; nationalism (Canadian, Aboriginal, Quebecois) and pluralism; principles of constitutionalism, constitution-making, and popular participation in constitution-making; the role of the Charter and Supreme Court; future constitutional efforts; and worldwide trends. The contributors agree that Canadian voters rejected the Charlottetown proposals because they disapproved of both their content and the procedure by which they were drawn up. They conclude that, while Quebec remains the chief problem for the Canadian constitution, Quebec was not the sole constitutional issue or the sole issue which determined how Canadians voted.

This work is the sixth volume in the Miller Center Bicentennial Series on Constitutionalism. The contributors examine in several different essays the historical, political, and ideological connections among the constitutional experiences of France, Poland, and the United States. As the clock struck midnight on December 31, 1992, Czechoslovakia, the only genuine democracy in post-World War I Central-Eastern Europe, broke up into two independent successor states. This book explores the failed search for a postcommunist constitution and it records in a lively style a singular instance of the peaceful settlement of an ethnic dispute.
For more than three years after the implosion of the Communist regime in 1989, the Czechs and Slovaks negotiated the terms of a new relationship to succeed the centralized federation created under communism. After failing to agree to the terms of a new union, the parties agreed on an orderly breakup.
In the background of the narrative loom general issues such as: What are the sources of ethnic conflict and what is the impact of nationalism? Why do ethnic groups choose secession and what makes for peaceful rather than violent separation? What factors influence the course of postcommunist constitutional negotiations, which are inevitably conducted in the context of institutional and societal transformation? The author explores these issues and the reasons for the breakup.
Eric Stein, a well-known scholar of comparative law and a native of Czechoslovakia, was invited by the Czechoslovak government to assist in the drafting of a new constitution. This book is based on his experiences during years of work on these negotiations as well as extensive interviews with political figures, journalists, and academics and extensive research in the primary documents. It will appeal to historians, lawyers, and social scientists interested in the process of transformation in Eastern Europe and the study of ethnic conflict, as well as the general reader interested in modern European history.
Eric Stein is Hessel E. Yntema Professor Emeritus, University of Michigan Law School. He previously served with the United States Department of State in the Legal Advisor's Office. He is the author of many books and articles on comparative law and the law of the European Community.
