Editorial Review:

This volume--the fifth in a series providing key documents for the constitutional history of the British Empire and Commonwealth from the twelfth century to the twentieth--deals with those dependencies of the Crown where for various reasons it was considered premature to concede fully representative, let alone responsible, government, and also with Ireland where the union with Britain made in 1800 was coming under increasing strain. It covers the years from 1840 to 1900, in parallel with the companion volume IV which dealt with the four main settler colonies. The documents in this volume illustrate the ways in which Britain attempted to devise forms of government it was thought would be, at least in the short term, more suitable for dependencies which had few British settlers who might successfully operate a representative system--and where the majority of indigenous peoples needed protection against such a minority. There was, however, a desire that such colonies should be as self-governing and self-sufficient as possible, but a commitment to "trusteeship" operated against any rule-of-thumb concession of the sort of constitutions granted contemporaneously to settler colonies. The first section of this volume focuses on British imperial authority and the means whereby it attempted to exercise supervision over the scattered parts of the dependent empire (the so-called British settlements; protectorates under extra-territorial jurisdiction; the use of chartered companies). India is the subject of the second section: documents are here included illustrating the transfer of power from a chartered company back to the Crown and the hesitant moves toward quasi-representation on the Indian councils. A third section is concerned with the collapse of the "old representative system" in the West Indian colonies and the experiment with a "responsive" government in Jamaica. The fourth section shows what happened to the original Crown colonies and to new ones acquired in this period, together with adjacent spheres of influence and protectorates. There is then a section dealing with a group of special cases--the Ionian Islands, Cyprus, and Egypt, while the final section deals with the unique problems of Ireland and the attempts made to devolve a measure of internal self-government on "John Bull's other Island" to appease growing nationalist and inter-sectarian tensions.

A book to explain the existing cultural difference 5 out of 5 stars.

A major impact of this book is Inoue's explanation on dignity of individuals that for Japanese are not well consistent with American values. Japanese in general are afraid of expressing individuality (kosei) as such can be subjected to the bullying (ijime) by fellow Japanese in a group--be it shcool or workplace. This is a main reason why skipping the grades in school are not usually allowed in Japanese education system. In Japan, if you are too good, you will be bullied.

Editorial Review:

The Japanese constitution as revised by General MacArthur in 1946, while generally regarded to be an outstanding basis for a liberal democracy, is at the same time widely considered to be--in its Japanese form--an document which is alien and incompatible with Japanese culture. Using both linguistics and historical data, Kyoto Inoue argues that despite the inclusion of alien concepts and ideas, this constitution is nonetheless fundamentally a Japanese document that can stand on its own.

"This is an important book. . . . This is the most significant work on postwar Japanese constitutional history to appear in the West. It is highly instructive about the century-long process of cultural conflict in the evolution of government and society in modern Japan."--Thomas W. Burkman, Monumenta Nipponica

Editorial Review:

This major work, written by prominent South African academics, is an introduction to the new constitutional order in South Africa. It does not aim to provide a detailed commentary on fundamental rights in South Africa, but instead seeks to place the rights affirmed in the constitution in a comparative and international context. In doing so the book focuses upon the principles that form the foundation of the new constitutional order: the supremacy of the Constitution, the notion of a democratic constitutional state, and the judicial protection of fundamental rights. This is a book which will be of interest to all lawyers and political scientists particularly those interested in constitutionalism and constitutional litigation.

Editorial Review:

On a snowy November day in 1872, the premier of Ontario is speaking in his constituency, and he tells a story - the story of his people's long struggle for liberty ...

With this vignette Paul Romney leads us onto a lost middle ground between conflicting visions of Canada's past. He reminds that both French and English Canadians once regarded Confederation as a compact of provinces and of peoples, designed to permit each partner to cultivate its own distinct society. In English Canada that original conception gave way to a nationalist myth, which alienated French Canadians by its celebration of nation-building and exaltation of federal power. English Canada's forgetting resulted in a "historic blunder" - patriation of the Canadian constitution without Quebec's consent.

How did that happen? Romney presents the politics of nineteenth-century Ontario as a confrontation between two competing myths - one of resistance to subversion, and one of resistance to oppression. The latter sustained a long struggle for local autonomy, leading successively to colonial self-government, Confederation, and the entrenchment of provincial rights. It fitted well with the French-Canadian idea of Confederation. But immigration, industrialization and a growing sense of Canadian nationhood transmuted both myths into rival nationalisms - one liberal and anti-British, the other conservative and anti-American, but both of them centralist in orientation.

Ranging across two centuries, this provocative book reveals Canadians in confrontation with the Americans, the British, and each other. It argues that prospects for Canadian unity must depend on recognizing Confederation's true complexity as a compact of peoples and provinces, and on reconciling English-Canadian and Quebecois understandings of Canada's past.

Lively yet learned, Getting it Wrong is a history book that speaks to Canada's present condition.

Editorial Review:

Published in 1966, The Stuart Constitution at once established itself as the standard documentary textbook for courses in English seventeenth-century history in schools (A-level), polytechnics, and universities, and one which at the same time offered an individual revisionist outlook on many of the problems involved. For the second edition Professor Kenyon has entirely rewritten his commentary to take account of the latest research in this field; he has thoroughly revised the structure of the book, and he has also strengthened the documentation in several important areas, notably the Interregnum, 1649-1660. The book is divided into four parts, the first three of which are devoted to the periods 1603-1640, 1640-1660 and 1660-1688 respectively. The fourth part deals with some of the general issues of government, at both central and local level, throughout the seventeenth century. One hundred and forty-six documents are included in all, and to aid the student reader speling and punctuation have been modernised. This volume forms a companion to the second edition of Professor Elton's The Tudor Constitution, and is likewise available in both hard and paper covers.
