One of the weaker E&E titles 2 out of 5 stars.
11 of 12 people found this review helpful.

I normally love E&E. (The civil procedure E&E is wonderful). This one highly lacks.

The explanations of the concepts (before the examples) are poor. They barely skim the surface of certain concepts and as a result, I kept having to use another supplements to 'supplement' the explanations of this supplement. The explanations do not not give you enough black letter law.

The strength in this title - UPC intestate distribution discussion and examples. That's about it.

Excellent reference tool 5 out of 5 stars.

This is an excellent reference tool, especially for estate and trust administration paralegals. It is good for those with a low to intermediate knowledge base of the subjects.

    Editorial Review:

Regarded as one of the best casebooks available for any course, this comprehensive text combines interesting cases, well-tailored notes, and a clear organization into an excellent teaching tool.

The new Seventh Edition retains the late Jesse Dukeminier’s unique blend of wit, erudition, insight, and playfulness and covers all the key topics in a logical, clear organization. Included are interesting cases that are not only fun to read, but fun for professors to teach as well. Cases are enhanced and connected to broader legal principles by well-written notes, questions, and problems and cartoons, illustrations, and photographs provide humorous interruptions and visual commentary at appropriate places within the text. New authors James Lindgren and Robert Sitkoff updated the book to reflect legal change while remaining careful to retain the same interesting mix of cases, engaging notes and flexible organization that makes this a highly successful casebook. Additions and improvements to the previous edition include due attention to new developments in law reform by the ALI and NCCUSL such as: Restatement Third, Trusts (2003, Uniform Trust Code (2000) including proposed 2004 amendments, Restatement (Third) of Property: Wills and Other Donative Transfers (2001, 2003)and Uniform Disclaimer of Property Interests Act (2002. Attention is given to ongoing developments in the law such as inheritance rights of posthumously conceived children, standing of donors in suits against the trustees of charitable trusts, the rise of domestic offshore self-settled spendthrift trusts, the erosion of the rule against perpetuities and the rise of the perpetual, generation-skipping trust. There is enhanced coverage of increasingly important topics such as fiduciary administration and trust investment law (including modern portfolio theory, diversification, the principal and income problem, and measuring damages; and inheritance rights of same-sex partners, inheritance rights of children, with comparison to the other common law countries (which are far more generous to children). Also included is a more logical presentation of nonprobate transfers and their role in estate planning, fully updated tax chapter with attention to new developments such as the Economic Growth and Tax Relief Reconciliation Act of 2001. Notes, questions, and problems have been revised throughout where appropriate in light of the foregoing and other developments.

Unequal Protection: The Rise of Corporate Dominance and the Theft of Human Rights

Was the Boston Tea Party the first WTO-style protest against transnational corporations? Did Supreme Court sell out America's citizens in the nineteenth century, with consequences lasting to this day? Is there a way for American citizens to recover democracy of, by, and for the people?

Thom Hartmann takes on these most difficult questions and tells a startling story that will forever change your understanding of American history. He begins by uncovering an original eyewitness account of the Boston Tea Party and demonstrates that it was provoked not by "taxation without representation" as is commonly suggested but by the specific actions of the East India Company, which represented the commericial interests of the British elite.

Hartmann then describes the history of the Fourteenth Amendment--created at the end of the Civil War to grant basic rights to freed slaves--and how it has been used by lawyers representing corporate interests to extend additional rights to businesses far more frequently than to freed slaves. Prior to 1886, corporations were referred to in U.S. law as "artificial persons." but in 1886, after a series of cases brought by lawyers representing the expanding railroad interests, the Supreme Court ruled that corporations were "persons" and entitled to the same rights granted to people under the Bill of Rights. Since this ruling, America has lost the legal structures that allowed for people to control corporate behavior.

As a result, the largest transnational corporations fill a role today that has historically been filled by kings. They control most of the world's wealth and exert power over the lives of most of the world's citizens. Their CEOs are unapproachable and live lives of nearly unimaginable wealth and luxury. They've become the rudder that steers the ship of much human experience, and they're steering it by their prime value--growth and profit and any expense--a value that has become destructive for life on Earth. This new feudalism was not what our Founders--Federalists and Democratic Republicans alike--envisioned for America.

It's time for "we, the people" to take back our lives. Hartmann proposes specific legal remedies that could truly save the world from political, economic, and ecological disaster.

Do right by your kids...get this book 5 out of 5 stars.
2 of 2 people found this review helpful.

I have several estate planning books...the "how to" type and they are great. This is the book you need to read before you start filling in the blanks. I wish my parents had read this book. It would have saved my family relationships. This book gives you the basic information you need before drawing up your trust. Protect your beneficiaries and prevent family conflict by reading this book!

Lots of mini-cases; Easy to read 4 out of 5 stars.
2 of 2 people found this review helpful.

Only estate book I've seen written in an easy-to-read, mini-case-study format. Very practical and thought-provoking advice. Tends to focus on little worst-case scenarios in an attempt to get people to plan properly for all the things that can go wrong in an estate.

For what it's worth, I thought the book was generally best-suited for estates with $100,000 to about $2,000,000 in assets. Don't get me wrong, there's something in here for all estate sizes - especially for people just starting the process of developing a plan. However, don't buy this book looking for technical discussions of advanced tax-minimizing strategies. If you or your clients have estates over this $2MM mark, this book can be a great thought-provoker, but some of the advice isn't really suitable for larger estates.

    Editorial Review:

For everyone concerned with preventing family conflict over their estates, this is the first book to give precise instructions that ensure that each heir receives an equitable and thoughtful legacy--while the IRS and lawyers get the minimum amount.

    Editorial Review:

No other book covers living trusts better -- or more simply -- than this bestselling book.

Death may be inevitable, but probate doesn't have to be. By creating a living trust, your property will bypass lengthy and expensive probate proceedings and go directly to the people you've designated, quickly and easily.

Make Your Own Living Trust explains how to create a living trust, transfer property to the trust and amend or revoke the trust at any time. Specifically, it covers how to:

  • create various living trusts, including an AB trust (also known as a "marital trust" or "bypass trust")
  • transfer assets to your trust, including real estate, stocks and bonds, jewelry, art or a small business
  • name beneficiaries for all trust property
  • sign your document and make it legal
  • appoint someone to manage property left to minors or young adults
  • provide for trust property management if you become incapacitated
  • retain absolute control over trust property while you live

Make Your Own Living Trust includes all the forms you need -- as tear-outs and on CD-ROM -- to create your own trust, plus step-by-step instructions for filling them out.

Completely updated and revised, the 8th edition covers the latest laws and information about federal and state estate taxes.

Good in all states except Louisiana.

    Editorial Review:

Wydick s Plain English for Lawyers--now in its fifth edition--has been a favorite of law students, legal writing teachers, lawyers, and judges for over 25 years.

In January 2005, the Legal Writing Institute gave Wydick its Golden Pen Award for having written Plain English for Lawyers. The Legal Writing Institute is a non-profit organization that provides a forum for discussion and scholarship about legal writing, analysis, and research. The Institute has over 1,300 members representing all of the ABA-accredited law schools in the United States. Its membership also includes law teachers from other nations, English teachers, and practicing lawyers.

The LWI award states: 'Plain English for Lawyers . . . has become a classic. Perhaps no single work has done more to improve the writing of lawyers and law students and to promote the modern trend toward a clear, plain style of legal writing.'

In 2003 Wydick retired after 32 years on the law faculty of the University of California, Davis. But he still teaches his favorite course -- a seminar in advanced legal writing for third-year law students. For the past eight summers he has also lectured at the International Legislative Drafting Institute presented in New Orleans by the Public Law Center, a joint venture of Tulane and Loyola law schools. There the audience consists of lawyers and non-lawyers from abroad who earn their living drafting legislation in many different languages. 'Teaching at the Institute,' Wydick says, 'is a precious opportunity to learn how much we English-users have in common with people who write laws in other languages.'

How does the fifth edition of Plain English for Lawyers differ from its predecessors? It remains (in size only!) a little book, small enough and palatable enough not to intimidate over-loaded law students. 'Most of the text remains the same,' Wydick says, 'but in the past seven years I ve learned some new things about writing in English, and I want to share that with the readers.' In addition, the exercises at the end of the chapters are different (a welcome change for long-time teachers who are tired of the old ones). Finally, the teacher's manual includes additional exercises that teachers can give to students who want or need extra practice.

Decent, but rather uneven coverage for an intro text. 3 out of 5 stars.
8 of 8 people found this review helpful.

One benefit of this book is that it contains articles, commentary, and discussion questions all in one text. It also covers a wide variety of issues, which is good since business ethics is a vast subject. On the negative side, I don't think the organization of the sections is the most effective way to approach the topic. The sections are organized based on a 1991 survey of CEOs in which the participants ranked their most important types of ethical dilemmas. As a result, there isn't the logical flow or progression of ideas from chapter to chapter that one might expect from a philosophy book. Unfortunately, the pragmatic interests of CEOs are not the same as the educational needs of students who are new to business ethics. There is also no discussion of ethical theories and no direct interaction between the articles. On the whole, this book may be beneficial if used in conjunction with a survey of ethical theories and ethical decision-making, but taken by itself it makes for a rather uneven introduction to business ethics.

    Editorial Review:

Packed with real-life examples, BUSINESS ETHICS: CASE STUDIES AND SELECTED READINGS, 6th Edition explores the complex issues of ethics from the inside. Offering a unique perspective, this market-leading text gets behind the decision-making process of today’s business leaders -- from prominent players to everyday professionals. It helps you dissect what makes people cross lines they would not ordinarily cross. A combination of short and long cases, readings, hypothetical situations, and current ethical dilemmas, BUSINESS ETHICS provides a thorough training and thought-provoking experience on business ethics. Applying theory to real-world practice, it reinforces a vital sense of values in future business leaders.
