Good book for mineral owners as well as students 4 out of 5 stars.

The third edition of this book was very helpful, and also included more recent case law cites than the second edition. I would assume this it true with the fourth as well (and there have been quite a few post 1995 court cases affecting royalty payments among other things). John Lowe is a well-respected professor of oil and gas law and has written many papers as well as several books on the subject.I find his writing style easy to understand, even for a layman like myself.I also found it to be much more than a "nutshell" approach in that the explanations of complicated ideas are fairly complete in most cases. He even touches on the structure and content of oil and gas sales contracts near the end of the book, which I found helpful as well.

The book has an excellent presentation of the theory of contracts. The six main categories are described initially and explained in the ensuing text. These categories consist of:
1. Express contracts consisting of the standard offer-acceptance
and consideration trilogy
2. Implied in fact contracts distinguished by conduct rather than
by express words
3. Promissory estoppel referred to as detrimental reliance
4. Subsequent promises to perform pre-existing obligations
5. A minority theory of imposing liability based upon a subsequent promise to pay for material benefits previously conferred.
6. Implied in law quasi-contracts which are non-consensual obligations

The theory of an offer arouses an expectation in the mind of a
reasonable person. Such an expectation may create a power of
acceptance in the offeree. An offer must be sufficiently certain
to make any resulting agreement enforceable and damages calculable. The offer must be certain as to the parties, subject matter, price and time of performance. An offer in which the
offeror or offering party promises to do or not to do something in exchange for a promise by the offeree to act is an offer for
a bilateral or two-sided contract. Further details as to
bargained exchanges, the statute of frauds and a whole host
of complicating factors are set forth simply with a generous
sprinkling of stare decisis cases to illustrate the legal
points explained. The text will be helpful for law students,journalists, constitutional scholars and a whole host of
other constituencies in academe.

This text is a good supplement to the standard legal texts on contract law. It is well worth the price charged.

The most difficult thing about studying any body of laws resides, not in its substance, but in its presentation. One advantage of immigration law is that it relies heavily on fairly stable categories. This book should help anyone but the most impatient to build a first outline of the main categories of immigration law--with helpful annotations.

15 chapters: 1-4 (background information--including history and constitutional law); 5 (immigrant visas), 6 (nonimmigrant visas), 7 (zooms on student visas--a sub-category of nonimmigrant visas), 8 (removal--formerly "deportation"), 9 (inadmissibility), 10 (refugees/asyless), 11 (international law), 12 (citizenship), 13 (zooms on rights of aliens in general), 14 (criminal aspects of immigration law), 15 (ethical practice).

My main advice is to take good note of the general INA and CFR provisions under each category and subcategory, and names (and holdings, why not) of important cases. Add that to your outline, and you have a fine guide for further research. In other words, if your goal is to familiarize yourself with the field AS A WHOLE for the first time, don't get bogged down in the discussions of legal history and cases at first (yes, this is not a manual, so what's the point?)--except for the general history of US immigration law at the start of the book, which gives you a good first sense of the "spirit" of US immigration policy. You could come back to those discussions later, without the aggravation.

I do not recommend delving directly into any body of laws that is as extensive as immigration law, unless of course you have a few years to spare--but then again why waste that time? Think of books like this one as you would of maps: you don't want to have to start looking for California, street by street, starting in Washington DC. The point is this: an overview is always useful. This one should help you, if you use it properly.

Mutual Mistake, The Mailbox Rule, and Other Legal Fictions 5 out of 5 stars.

"Hornbooks" are summaries of a body of law used by angst-ridden law students to amplify and clarify the often arcane materials contained in Casebooks. The law of Contracts is one of the primary building blocks of a first year legal education, along with Property and Torts. Almost every 1L has a small library of these dark green encyclopedic volumes that weigh in by the kilogram.

CALAMARI AND PERILLO ON CONTRACTS is one of the few Hornbooks (along with PROSSER AND KEETON ON TORTS) that is considered an acceptable, though not authoritative, treatise for purposes of legal citation. Of course, cases themselves trump any other source material.

This is a very good, albeit very, very dense discussion of the Law of Contracts, which is one of the most intellectually challenging areas of the law. Most of the great legal theorists were Contracts specialists.

Most of our Common Law is a variation on Contract law---Torts is a violation of the Social Contract resulting in civil injury; Criminal law is a violation of the Social Contract resulting in wrongs punishable by incarceration or other sanctions; Property is all about implied (or express) contractual understandings as to the holding of title and interest; even Civil Procedure and Evidence are forms of Contract, a system of agreed-upon rules for conducting cases.

The sheer density of the material in CALAMARI AND PERILLO ON CONTRACTS makes this book less helpful than it might be to an overwhelmed law student. A typical 1L just doesn't have the time to parse and unpack this mahogany block of a text. There are other books out there that are more quickly and easily accessible, but none that acheives the depth of this particular volume. It is a "must have" for anyone serious in familiarizing themselves with the realm of Contracts.

So many years after the intellectual concentration camp that is First Year Law School, I find that perusing Hornbooks for interesting minutiae can be a rather enjoyable way spend a rainy, quiet afternoon. It's too bad that most law schools make grasping the underpinnings of the U.C.C. feel like root canal without novocaine. Law has a beauty that is often ruined by legal education.

If you plan to carry your Hornbooks around, get yourself a litigation case on wheels; it'll spare you a future of back problems.

As a foreigner to study law in the U.S.,I find it very difficult
for me to comprehend what the casebooks are trying to express.
I was suggested to search for the nutshell related to the Robert W. Hamilton's thick,heavy and hard-to-understand casebook on Corporations here at Amazon. After I browsed through the introduction of this little book, I found it very concise in expression and easy to catch the points. I consider it a great aid for those who find it hard to study the Hamilton's casebook.

What a useless study guide. All this does is reprint the chapter summary and removes a few words and asks you to fill in the blanks. Do not, repeat, NOT, waste your money on this.
What a cheap ripoff by the publisher.

Disregard reviews criticizing the technical nature of this book. I became a fond user of the Nutshell series when I was in law school; I don't think that these books were ever intended for use by the Average Joe. By its very nature, the subject matter is technical and can only be simplified so much. There is a reason why there is no such book as "International Taxation for Dummies" or "Brain Surgery for Dummies".

These books are great to use as a springboard for further research and study of the issues covered. I would recommend the book to students and practitioners of accounting, business, and taxation.

If you've been reading your partnership tax textbook scratching your head and wondering where they got this number or that number, this book will be an immense help as you go through the rules and try to understand them. The Logic of Subchapter K goes through the subject matter in a very organized and well-presented fashion that makes it much easier to tackle. I am currently an L.L.M. student in Taxation, and I've found that, in combination with a textbook and lectures, this book makes it possible to not just memorize the rules but to actually understand and be able to apply them. Great book.

Update: got an A in the class!
