The Wind Blows 4 out of 5 stars.
1 of 1 people found this review helpful.

The founding fathers would not like to read this book. It is well researched and presents a factual case to show that the highest court in the land is devoid of constitutional fortitude and is quite manipulative in its own manner. Not really what most americans expect.

The writing covering the elements of the key cases is quite interesting. Sections in between that show the games in the selection process were very chewey and not worth the shoe leather.

The writings giving insight to the lives of the justices and the relations between them are quite well done. It may not have been the point of the author, but he proved there are nuts on the court.

One reason the lay reader should pick up this book is to realize that the rule of law is a mere extension of the rule of politic. The lay man, common man, average joe may think he is protected by a constitution, but Mr. Toobin will show that it no longer exists. Depending on which way the wind is blowing, the court will move from one 'analysis' of law to the other to fit personal opinions rather than concept of the constitution. Rationalization, justification, twistification and plain old 'because I said so' are what really drives the process behind the black robes.

And if you never knew it before, this book will show you why lawyers are better than the rest of us.

Editorial Review:

In The Nine, acclaimed journalist Jeffrey Toobin takes us into the chambers of the most important—and secret—legal body in our country, the Supreme Court, revealing the complex dynamic among the nine people who decide the law of the land. An institution at a moment of transition, the Court now stands at a crucial point, with major changes in store on such issues as abortion, civil rights, and church-state relations. Based on exclusive interviews with the justices and with a keen sense of the Court’s history and the trajectory of its future, Jeffrey Toobin creates in The Nine a riveting story of one of the most important forces in American life today.

Editorial Review:

In their professional lives courtroom lawyers must do these two things well: speak persuasively and write persuasively. In this noteworthy book, two of the most noted legal writers of our day Justice Antonin Scalia and Bryan A. Garner systematically present every important idea about judicial persuasion in a fresh, entertaining way. Making Your Case: The Art of Persuading Judges is a guide for novice and experienced litigators alike. It covers the essentials of sound legal reasoning, including how to develop the syllogism that underlies any argument. From there the authors explain the art of brief-writing, especially what to include and what to omit, so that you can induce the judge to focus closely on your arguments. Finally, they show what it takes to succeed in oral argument. The opinions of Justice Scalia are legendary for their sharp insights, biting wit, and memorable phrasing. The writings of Bryan A. Garner, editor in chief of Black s Law Dictionary®, are respected inside and outside legal circles for their practical guidance on the art of writing and advocacy. Together the Scalia-Garner team has produced a fresh, innovative approach to a timeless topic.

Glannon is fantastic. This is a great book to review before exams, and it also is a great value!

Useful & recommended 4 out of 5 stars.

Though I ended up not having much use for this book due to my professor's distinctive teaching methodology, I still found it helpful in clarifying the basic concepts of Torts. The author injects a slightly dorky sense of humor into the narrative, which makes the information more accessible and easier to grasp. He also has a very clear, conversational writing style. Overall recommended (at least if you don't have my Torts professor).

Editorial Review:

As everyone knows, the United States Constitution is a tangible, visible document. Many see it in fact as a sacred text, holding no meaning other than that which is clearly visible on the page. Yet as renowned legal scholar Laurence Tribe shows, what is not written in the Constitution plays a key role in its interpretation. Indeed some of the most contentious Constitutional debates of our time hinge on the extent to which it can admit of divergent readings.
In The Invisible Constitution, Tribe argues that there is an unseen constitution--impalpable but powerful--that accompanies the parchment version. It is the visible document's shadow, its dark matter: always there and possessing some of its key meanings and values despite its absence on the page. As Tribe illustrates, some of our most cherished and widely held beliefs about constitutional rights are not part of the written document, but can only be deduced by piecing together hints and clues from it. Moreover, some passages of the Constitution do not even hold today despite their continuing existence. Amendments may have fundamentally altered what the Constitution originally said about slavery and voting rights, yet the old provisos about each are still in the text, unrevised. Through a variety of historical episodes and key constitutional cases, Tribe brings to life this invisible constitution, showing how it has evolved and how it works. Detailing its invisible structures and principles, Tribe compellingly demonstrates the invisible constitution's existence and operative power.
Remarkably original, keenly perceptive, and written with Tribe's trademark analytical flair, this latest volume in Oxford's Inalienable Rights series offers a new way of understanding many of the central constitutional debates of our time.

I Think You Can do Better Than This 2 out of 5 stars.
5 of 7 people found this review helpful.

I'm not being law-snobby, I promise.

I bought the book because I was struggling to get my head around remedies, and although it helped, I ended up buying Lexis' "Understanding Contracts," too.

I should disclaim that what follows is based on the remedies section (that's all I used it for). That's a big piece of contracts, but maybe the rest of the book, which I didn't explore, is better.

Okay, here goes:

I found the E&E book to be imprecise with some concepts and vocabulary. It could be my own quirkiness, but to me that imprecision was maddening. In one paragraph, a plaintiff had "moved," "pled" and also "applied" for summary judgement. Applied??? SJ isn't a credit card! And it's not a pleading for that matter, either.

If you find these types of imprecision trivial, the book might be for you. They left me wondering if there were any important issues being confused, as well. We all know that law exams ask us to identify doctrinal issues, weight them, and (if the opportunity presents itself) apply the particular policy analysis that our respective professors find endearing. The extent to which a secondary source like E&E leads us astray on the doctrine is the same extent to which we will be led astray on our exams.

If you are like me, you should buy "Understanding Contracts" from the corporate mongers at Lexis. I felt like the concepts and vocabulary were applied in a more precise, crisp way. It will save you from trying to infer what the author is trying to say from what the author did say, and it will save you from writing snooty remarks and question marks in the margin -- time you could be spending learning Contracts.

Julie's book is indeed a lifesaver! It came to my attention as I was beginning the process of downsizing my mother. Very difficult circumstances and this book was invaluable. Practical advice and comfort in knowing my situation was not unique. Julie has seen it all and the book reflects her expertise. I cannot recommend it highly enough and will buy multiple copies for my friends.

The book is great, but book took almost a month to get to me. Good thing my class does not start until October or else this book would have been pointless to get since it took so long.

Great taxation book, quick shipping! 5 out of 5 stars.

Great user-friendly taxation book. It is very easy to read, and explanations are clear and help you to understand the concepts. Book was true to description (NEW). Shipping was fast, received earlier than the estimated delivery date.

Comprehensive 5 out of 5 stars.

I think it lacks good practice problems that are comprehensive and that encompass more than one issue. It would be better if there were more visual representations of IRS forms. Overall the text itself is easy to understand and studying is easy as it is organized well.
