What about non-US photographers? 5 out of 5 stars.

Since my book on Model Releases has been published, I've been getting
lots of email asking whether the book applies to non-US photographers,
since I'm American and I cite many US laws.

First, I must point out that, while the book does cite a few laws,
this is not a legal book--it's a business book. Making smart business
decisions (such as whether to make money or to avoid risk) requires
more than just the knowledge of "law." This is especially the case
for all of the laws that apply when model releases would be applied,
regardless of whose laws or what country. What's more important is that
you understand the principles and concepts behind what the various laws
are intended to protect. Never are there conditions so cut and dried that
all you needed to know is the letter of the law and your decision-making
is done. That's why this is a business book--I examine (and explain) the
legal analysis and intent behind the scenes so you can make appropriate
financial risk-assessment decisions on a case-by-case basis.

Now, as for why US laws are so critical here, let's begin by understanding
the role of international trade and globalization. Whether intentional
or not, many more marketing materials companies use end up "landing" in
the US somewhere, somehow, in such a way that US laws could be triggered.
For example, say your local Canadian bank licenses one of your photos
of a farmer in Alberta. If they use it for ads it places on google adwords,
and the bank targets customers that also reside in the US, then that
farmer could have a claim in US courts for the use of his photo without
a release. This is because the bank is said to have "reach" into the
US because it is considered to be conducting business there. Hence, that
aspect of its business that it's doing (the ad) is subject to US laws. It
is not uncommon for non-US entities to file claims in US courts under
US laws, even though none of the parties involved may be US citizens.
The book gets into details about how and why all this works.

The larger point is that photographers that license images are more
likely than not to be selling to clients who could have this very kind
of exposure. Making matters worse is that the US has some of the most
punitive laws, where damages are very high. This all adds up to very
paranoid companies that want extra protection before they license any old
picture of a farmer. Indeed, anyone that does any kind of international
business at all will be very cognizant of US laws, and may only license
images that have releases that satisfy US laws.

Of course, it's true that a local German company that sells local beer
to a limited geographic region is not going to get called into a US
court just because they happen to have a website that has an unreleased
photo of someone and that website can be seen in the US. It'd be hard to
convince a judge that there's any real "presence" there. So, let's not
get carried away with ourselves: not every use of any photo is suddenly
subject to US laws or courts.

But, again, let me remind you of your job as a photographer: to cast the
widest net to catch as many buyers as possible. If you are knowledgeable
of (and comply with) US laws in your photo business, you will not only get
more potential US-based buyers of your imagery (not a small market by any
measure), but you'll have a better reach for your local buyers as well.
And that's really what this is all about.

Besides, if you understand the principles behind US laws, you will have
no problem doing analysis of your own laws, should they be any different.
The purpose of this book is to teach you how to think smart in business
terms, and analytically about law (insofar as you need to as a photographer).
You will come away much better prepared to sell into the global market
that you're already selling into.

Boring Postcards goes Stateside - 160 exquisitely dull postcards from America. In the original Boring Postcards Magnum photographer and postcard enthusiast Martin Parr brought together 160 of the dullest postcards of 50s, 60s and 70s Britain to make a book that was, paradoxically, both fascinating and extremely funny. It was one of those ideas that seemed so obvious that no one could believe it hadn't been done before, and it caught the public imagination in a big way. Boring Postcards was discussed everywhere from daytime TV shows to in-flight magazines, from The Times to the Time magazine. It was so successful partly because it was more than just a funny book. The very fact that such places and people were once considered to be interesting or beautiful enough to merit a postcard made us aware of the changes which had taken place. In effect, Boring Postcards was an alternative social and cultural history of Britain from the 1950s to the 1970s. Martin Parr subsequently turned his attention to the United States to produce Boring Postcards USA, 160 of the dullest postcards from the land of opportunity. Just as before, for a postcard to qualify as sufficiently 'boring', either its composition, or its content, or the characters featured, must be arguably boring, or the photograph must be absent of anything which might conventionally be described as interesting. The postcards in Boring Postcards USA include: 'Site of Proposed Larger Taconite Plant' (a field); 'The colourful rug near the entrance of the national offices of the American Baptist Churches' (a red rug); 'Sunset Travel Trailer Park' (some trailers); 'Pennsylvania Turnpike near the Philadelphia Interchange' (exactly what it says); 'Ariel View of the massive interchange complex of Federal Highways 1-75, 1-85, and I-20.' Once again, the design of the book reflects its contents by being at the cutting edge of dullness, sporting a neutral grey cover and captions in Helvetica, the typeface of choice for producers of boring postcards. Once again, these cards will provide not only a great deal of amusement but a commentary of how America has changed, a celebration of those places that have been forgotten by conventional history.

I'm an aspiring sports photographer, and I found this book to be exceptionally useful. The sample images alone are worth the price. Definitely would recommend to beginning/intermediate sports photographers - especially those who are wanting to do team and individual pictures.

In this book, Mr. Williams gives photographers a "step by step" guide to success in the field of school and league sports photography. He has included an in depth listing of all equipment necessary and the marketing tips and ideas are proven winners. If you have an interest in school and league sports photography, this book is a must have.

What a great book, I read it with in 24 hours of aquiring it. It is an easy read, full of information. I could tell straight away that the author has tried many marketing strategies over the past 3 decades and is saving me many hours and dollars by laying a simple path for my business to succeed. Armed with this book, and a 4 day seminar by Rob Provencher and James Hodgins, I am now making a living doing what I love to do...creating beautiful images, what could be better than that? Russell Miller outlines the history of the world's greatest photo agency from its founding shortly after World War II until its advancement into the 90's. He includes personal stories about many of the photographers. The book also charts a course between many of the conflicting visions held by the members for the purpose of the agency. As you read the book, you have to remind yourself that Magnum is a "cooperative," because rarely do the members show this spirit. At its start, Cartier-Bresson wanted pictures with artistic vision. Capa wanted hard core reportage. In later years, Martin Parr's overtly critical portrayals of his subjects tested the agency's humanistic mission. All along, the great photographers prove to be fantastically poor businessmen. Russell Miller's history of does a lot to humanize some of the gods of photojournalism. As someone who has spent several years in graduate school, I enjoyed hearing that not all of these people were perfect. It is genuinely funny to learn that Eugene Smith's seven year Pittsburgh project was actually only intended to be a two week assignment. What beginning photographer hasn't made the same kind of mistake, deciding that a story was worthy of far greater time than budgeted for by your teacher or editor? Miller's account of Smith probably goes so far as to provide a cautionary tale to aspiring photographers about the need to draw boundaries to your work life. This book would be a good addition to a college photography course. It covers its subject expansively, but it tells the story in a chronological narrative that keeps the reader turning pages quickly.
