A really great book, it finally brought some clarity to evidence. But be prepared to spend some time reading this book, as it has fairly in-depth coverage. Even so, I found it a very valuable study tool.

There is not much to this book, which is probably caused by the fact that there is not much to an intro evidence course. If you are taking an Evidence course based on the Federal Rules, I am not sure that this book is a whole better than getting the Federal Rules and reading its comments. Then why I am rating this book at 4 stars, rather than lower? Because what this E&E book does, it does well.

There is nothing more riveting than the law in a flash series - especially the Evidence flashcards. I remember Christmases past, sitting around the sparkling tree at the old cabin and laughing over the intricacies of hearsay with the whole family. Every time I see a stack of flashcards, I remember Grandpa's Rule 403 joke and smile.

Studying evidence can be intimidating. It is just an endless series of exceptions to the basic rule that anything relevant is admissible. And then exceptions to the exceptions. But the Law in a Flash series made it really manageable and easy to understand and remember in small pieces that are digestible even when your brain is mush.

Evidence, as one learns, is primarily "tribal knowledge" in that many of the rules are just something you need to learn the exceptions to, and they don't always make sense. These are great for learning evidence, but they should not be used as your only "question pack" because the cards provide points without a complex fact scenario. Siegel's and other books provide MBE and written-style questions that are more useful, but these are good for the basics. It is a shame they are not available for more topics. Be warned - many of these cards are duplicated in the "CrunchTime" book by the same company.

At six-hundred pages, your average overworked law student is not too keen on reading another 40 pages a night, especially with a full slate of classes. That being said, this book contains a "Casebook correlation chart," which helps you decide which part of the book to read in the approximate order of your own textbook. It covers: Green Nesson, "Evidence" (3rd Ed. 2000); Wellborn, "Cases & Mat..." (1st ed. 2000); Mueller & Kirkpatrick, "Evidence Under the Rules" (4th Ed. 2000), and Waltz & Park, "Evidence" (9th Ed. 1999).

I would suggest checking this out of your law library instead of buying it and reading the relevant parts of the "Capsule Summary" (79 pages) if you're pressed for time and you want a nuanced overview of Evidence.

The rest of the book is nicely outlined, but way too much information for the average to under-achieving student. However if you want it for clarification on certain rules, or just having it in your bookshelf would make you feel better about Evidence, you can get it so cheap that it can't hurt.

Excellent practice for both law school and Bar Exam 4 out of 5 stars.

This book contains 24 essay questions and model answers. In addition, it has 103 multiple choice questions that are similar to those on the multistate bar examination. Each question explains why the answer is correct and the other possible choices are wrong. The tricky hearsay exceptions were were explained.

Evidence can be very difficult, especially Heresay
this book had over 100 MBE Mult Choice Question and answer, most of them dealt with Heresay. Very Very helpful,(along with law in a flash flash cards) I did every question, and reviewed the ones I got wrong.

This is a must have if you're using the Waltz and Park textbook. But I recommend it no matter what textbook you have. The outline is very clear, very thorough, and lays out both Cal and Fed rules of evidence.

These cards were a great way for me to study for my exam. I found the colorful examples and the great black letter law and theory definition cards to be very effective. In addition the way these cards are organized is great.

If you're in a California non-ABA approved law school and after about nine months you are completely burnt out with your text books then start studying these criminal law flash cards. In the first 100 cards it clarifies legal terms that extend to torts as well such as vicarious liabilty and these flash cards go on to explain the exact difference between proximate cause and cause in fact for both criminal law and torts as well. These flash cards are not as hard to study as text books but they are not a substitute for them either. If you are 1ls in an ABA approved law school then disregard this review and study whatever your law professor recommends.

This text is fine, but I found out that the 10th ed. & 10th ed. revised are EXACTLY the same - they even have the same page numbers. So, if you have the option to use a used, regular 10th ed., I would definitely go with that.

Generally good, but slightly misleading on the hearsay questions 3 out of 5 stars.

This study guide consists of a lengthy diagnostic true-false examination covering all of the substantive areas of the Federal Rules of Evidence. It then contains four true-false exams on hearsay, in which a factual situation is presented and you are asked whether it is hearsay and, if so, whether an exception applies. There are then two multiple-choice exams for hearsay, five comprehensive true-false exams, and six comprehensive multiple choice exams.

The book does a good job of explaining its answers to particular questions. However, Professor Graham is rather idiosyncratic in his analysis of hearsay, basing it off of his own normative beliefs (what hearsay ought to be) rather than relying on what the Federal Rules and the Advisory Notes actually say. For instance, FRE 801(c) requires hearsay to be an assertive statement offered for the truth of the matter asserted. This definition is intended to exclude the Sea Captain example from Parke's opinion in Wright v. Tatham from the definition of hearsay. (A sea captain boarded inspected a boat, then took his family sailing on it. If offered to prove the seaworthiness of the boat, this is hearsay under the common law, but not under FRE 801(c)). However, on page 393, Professor Graham insists that this is the wrong view; his answers within the "objective" exams are based on his own subjective preferences. This would be fine if he provided a disclaimer within the answers provided that this is his personal view; because he does not, this could mislead students.

Further, Professor Graham insists that statements which serve as circumstantial evidence of the declarant's state of mind are hearsay. He essentially rejects the conventional view (McCormick's) on page 391. Again, it would be fine for him to make the disclaimer that his personal beliefs are idiosyncratic ones within the answer choices he provides, but he does not do so.

I would advise using this book only as a final step in preparing for a multiple-choice evidence exam. Relying on Professor Graham's views may cost you valuable questions if you are not able to identify when his views differ from those of your own professor. On evidence issues other than hearsay, this book is helpful and accurate.
