    Editorial Review:

Part of the Queer Ideas series, edited by Michael Bronski

A persuasive argument for why married couples, gay or straight, should not receive special rights denied to other families

Nancy Polikoff asserts that, in American law, marriage is the dividing line between those relationships that matter and those that don't. A woman married to a man for nine months receives Social Security benefits when he dies; a woman living for nineteen years with a man or woman to whom she isn't married receives no government support.

Beyond (Straight and Gay) Marriage reframes the family-rights debate by arguing that marriage should not bestow special legal privileges upon couples because people, both heterosexual and LGBT, live in a variety of relationships—including unmarried couples of any sexual orientation, single-parent households, extended biological family units, and myriad other familial configurations. These relationships, like marriage, are about building and sustaining economic and emotional interdependence and nurturing the next generation. Polikoff shows how the law can value all families, and why it must.

"Polikoff wades through legislation and legalese with style and substance, plus a touch of flair. Impeccably researched, Beyond (Straight and Gay) Marriage offers an evocative read that takes in the full breadth of the issues affecting marriage and avoids pedantry while remaining persuasive."
    —Publishers Weekly

"Polikoff's argument is provocative, illuminating, and original."
—John D'Emilio, author of Lost Prophet: The Life and Times of Bayard Rustin

    Editorial Review:

From the Mormon Church's public announcement of its sanction of polygamy in 1852 until its formal decision to abandon the practice in 1890, people on both sides of the "Mormon question" debated central questions of constitutional law. Did principles of religious freedom and local self-government protect Mormons' claim to a distinct, religiously based legal order? Or was polygamy, as its opponents claimed, a new form of slavery--this time for white women in Utah? And did constitutional principles dictate that democracy and true liberty were founded on separation of church and state?

As Sarah Barringer Gordon shows, the answers to these questions finally yielded an apparent victory for antipolygamists in the late nineteenth century, but only after decades of argument, litigation, and open conflict. Victory came at a price; as attention and national resources poured into Utah in the late 1870s and 1880s, antipolygamists turned more and more to coercion and punishment in the name of freedom. They also left a legacy in constitutional law and political theory that still governs our treatment of religious life: Americans are free to believe, but they may well not be free to act on their beliefs.

    Editorial Review:

By investigating the harms routinely experienced by the victims and survivors of domestic violence, both inside and outside of law, "Everyday Harm" studies the limits of what domestic violence law can - and cannot - accomplish. Combining detailed ethnographic research and theoretical analysis, Mindie Lazarus-Black illustrates the ways persistent cultural norms and ingrained bureaucratic procedures work to unravel laws designed to protect the safety of society's most vulnerable people. Lazarus-Black's fieldwork in Trinidad traces a story with global implications about why and when people gain the right to ask the court for protection from violence, and what happens when they pursue those rights in court. Why is it that, in spite of laws designed to empower subordinated people, so little results from that legislation? What happens in and around courts that makes it so difficult for people to obtain their legally available rights and protections? In the case of domestic violence law, what can such legislation mean for women's empowerment, gender equity, and protection? How do cultural norms and practices intercept the law?

Howell does a great job examining how Renaissance women protected their interests, and the interests of their children. her book is extremely detailed and well researched. Although my historical interests are as far away from Renaissance Europe, this book sure raised my interest level

    Editorial Review:

Medieval Douai was one of the wealthiest cloth towns of Flanders, and it left an enormous archive documenting personal financial affairs--wills, marriage agreements, business contracts, and records of court disputes over property rights of all kinds. Historian Martha Howell reveals how these documents were produced in a centuries-long effort to regulate--and ultimately redefine--property and gender relations.

A thoroughly researched and interesting account of one of the under-examined mileposts in the still on-going civil rights struggle. Ms. Newbeck evokes the Loving case, as well as its antecedents and successors, in their historical, political and very personal contexts. As noted in the book description, this is also a particularly timely book in light of the current controversies regarding gay marriage.

    Editorial Review:

This landmark volume chronicles the history of laws banning interracial marriage in the United States with particular emphasis on the case of Richard and Mildred Loving, a white man and a black woman who were convicted by the state of Virginia of the crime of marrying across racial lines in the late 1950s. The Lovings were not activists, but their battle to live together as husband and wife in their home state instigated the 1967 U.S. Supreme Court ruling that antimiscegenation laws were unconstitutional, which ultimately resulted in the overturning of laws against interracial marriage that were still in effect in sixteen states by the late 1960s.

just a starting point 5 out of 5 stars.
7 of 8 people found this review helpful.

The debate regarding same-sex marriages appears as if it will be a huge issue in 2004. For example,at the courthouse in San Francisco performed over 400 marriages (same sex) on February 14, 2004. They normally only perform a little over 400 weddings (opposite sex) a month. This means that many gay couples are committed to each other and want to make it legal in the eyes of the law.

This book takes many point of views - some extremists that feel same-sex marriage will ruin their own heterosexual marriages. Lesbians who feel that the idea of marriage is outdated and repressive to the females involved in it. And some folks who seem to have given this issue a bit more thought and express their viewpoints well.

No matter where you stand on this important issue, you will find an essay that will reflect your view. I would suggest you also read the other essays to find out how other people feel about the issue so when it comes down to debating this hot topic, you will know the various opinions of your supporters as well as your opponents. You'll be able to state your case in a way that should be able to get your point across. I recommend this book highly.

    Editorial Review:

The issue of same-sex marriage has attracted the attention of the nation and has become one of the most heated social controversies. This completely revised and updated second edition of "Same-Sex Marriage" presents a balanced selection of the latest, the most diverse, and the most clearly argued positions advocated by academics, politicians, journalists, attorneys, judges, and activists.
