Stolen 3 times... This book is hot!!! 5 out of 5 stars.
16 of 18 people found this review helpful.

This book is so hot that it's been stolen from my office library 3 times. I'm on my 4th purchase of this book. I felt like I could have an intellegent conversation about any aspect of the television business after using this book. It is my main resource for getting quick answers that are easy to understand. This is required reading for those getting started and a great resource for those that have been in the industry a while. It also includes a computer disk containing forms such as U.S. Copyright registration and others found in the book that you can import to your word processor.

Editorial Review:

The legendary Charles C. "Cash and Carry" Pyle, considered by most to be the first sports agent, negotiated a $3,000-per-game contract for Red Grange to play professional football for the Chicago Bears in 1933. Today, salaries in the tens of millions of dollars are commonplace, and instead of theatrical promoters and impresarios, professionally trained businessmen and lawyers dominate the business. But whereas rules and penalties govern the playing field, there are far fewer restrictions on agents. Incidents of agents' manipulating athletes, ranging from investment scams to outright theft of a player's money, are far too frequent, and there is growing consensus for reform

In The Business of Sports Agents, Kenneth L. Shropshire and Timothy Davis, experts in the fields of sports business and law, examine the history of the sports agent business and the rules and laws developed to regulate the profession. They also consider recommendations for reform, including uniform laws that would apply to all agents, redefining amateurism in college sports, and stiffening requirements for licensing agents. This revised and expanded second edition brings the volume up-to-date on recent changes in the industry, including:

- the closing of one of the largest agencies
- high-profile personnel moves
- passage of the federal Sports Agent Responsibility and Trust Act
- the National Football League's aggressive and high-profile efforts to regulate agents

Super Helpful Book on Entertainment Industry 5 out of 5 stars.
15 of 16 people found this review helpful.

I work at a Production company and a lot of contracts we hand to outside lawyers, but this is a good tool for me because it goes into details and discusses each point in a contract. This is something I'd love to have had many years ago, when I just got started in the business, and now that I have it, I am learning a lot of new things. There isn't any other book out there- quite like this.

Editorial Review:

Two entertainment attorneys and Hollywood insiders explain all the ins and outs of negotiating in the movie industry, including back ends, gross and adjusted gross profits, deferments, box office bonuses, copyrights, and much more.

This easy-to-follow reference–written clearly, without confusing legal jargon–is packed with expert insights on distribution, licensing, and merchandising. The book's invaluable resource section includes definitions of lingo for acquisition agreements and employment deals, twelve ready-to-use sample contracts, and a directory of entertainment attorneys in both New York and Los Angeles. With the negotiating tips in this guide, agents, writers, directors, actors, financiers, and filmmakers will save thousands of dollars in attorney fees.

Has room for improvement... 3 out of 5 stars.
1 of 1 people found this review helpful.

1. There are too many cases to illustrate the same point. For example, the Remedies section does not nearly need to be as long as it is. The bankruptcy section would be just as adequate and informative with 2-3 cases and more commentary. The agency rules chapter and the chapter on literary publishing also have this same problem: it is repetitive and there are too many cases with the same point. Some of the cases would have been been just as effective as a note case.

2. The size of the font for the note cases are too small and sometimes, an eye strain to read. I understand that there is a concern for the length of the book, but with the first suggestion and using thinner pages may fix this. (this book uses paper that is considerably thicker than your average law book). Also, sometimes, with the center justification alignment for the note cases, it squeezes the sentences together, it's almost impossible to read. (see page 199, note 3, the third line --the entire line is practically one word).

3. On the plus side, I do like how the book goes through entertainment agreements. For example, the detailed discussions on music publishing agreements with comments after each provision were very helpful.

Editorial Review:

In response to the increasing convergence of technologies in the entertainment industries, this thoroughly updated and revised fifth edition makes the casebook more timeless. Providing contract templates covering book publishing, recording contracts, actor agreements, video game agreements, and internet agreements, among others, this new edition is more useful and illustrative of the business of entertainment for lawyers, students, and industry professionals than its competition. Introductions, notes, and cases are fully updated to take into account recent changes in the industry. This classic casebook is essential to students at law schools throughout the country and to industry professionals trying to keep up with this ever-changing field of law.

Editorial Review:

Is the Internet erasing national borders? Who's really in control of what's happening on the Net--Internet engineers, rogue programmers, the United Nations, or powerful countries?
In this provocative new book, Jack Goldsmith and Tim Wu tell the fascinating story of the Internet's challenge to governmental rule in the 1990s, and the ensuing battles with governments around the world. It's a book about the fate of one idea--that the Internet might liberate us forever from government, borders, and even our physical selves. We learn of Google's struggles with the French government and Yahoo's capitulation to the Chinese regime; of how the European Union sets privacy standards on the Net for the entire world; and of eBay's struggles with fraud and how it slowly learned to trust the FBI. In a decade of events, the original vision was uprooted, as governments time and time again asserted their power to direct the future of the Internet. The destiny of the Internet over the next decades, argue Goldsmith and Wu, will reflect the interests of powerful nations and the conflicts within and between them.
Well written and filled with fascinating examples, this is a work that is bound to stir heated debate in the cyberspace community.
"A timely look at the ways that governments make themselves felt in cyberspace. Goldsmith and Wu cover a range of controversies, from domain-name disputes to online poker and porn to political censorship. Their judgments are well worth attending."
--David Robinson, Wall Street Journal
"In the 1990s the Internet was greeted as the New New Thing: It would erase national borders, give rise to communal societies that invented their own rules, undermine the power of governments. In this splendidly argued book, Jack Goldsmith and Tim Wu explain why these early assumptions were mostly wrong. By turns provocative and colorful...an essential read."
--Sebastian Mallaby, Editorial Writer and Columnist, The Washington Post

Intermediate Level Music Law 5 out of 5 stars.
4 of 4 people found this review helpful.

This is (for the most part), clearly written in a straightforward manner, but you'll waste a lot of time if you don't already have a foundation.

Prerequisites:

1. "Everything You Need To Know About The Music Business" (Donald Passman)
2. "Music Law: How to Run Your Band's Business" (Richard Stim)

boring but necessary 4 out of 5 stars.
2 of 3 people found this review helpful.

This book was so boring but it is necessary and I'm glad it exists. You do need a lawyer to absorb it or at least when you're negotiating your own contract. Reading it made me feel smarter and more boring. I could have done without the cheesy quotes. The other thing that gets me is that I have been offered contracts that look nothing like what's in this book by the same people that are on the "Billboard" chair committees etc. so it makes me wonder if what is published here is truly "industry standard".

Editorial Review:

This comprehensive reference features in-depth discussions of every important music industry contract, all enlivened by personal anecdotes from the author's wide-ranging experiences. Updated to reflect the rapid pace of change in the music industry, this new edition includes a focus on group agreements, live performances, free music on the Internet, the effect of the Millennium Copyright Act, ancillary rights, and the independent record label. Other key issues covered include the artists' rebellion against record company contracts, litigation by superstars and songwriters against record labels, and the industry-wide downturn in record sales.

Awful Casebook 1 out of 5 stars.
3 of 3 people found this review helpful.

As a 3L, I can definitely say that this is THE WORST casebook I have had the misfortune of being forced to buy and use. It had little to no orienting and introductory material and far too many cases. No good case book has tons of cases stuffed into the note section of one topic. If it is that important that you need three or four pages in the NOTE section, then why not just make it a full case or excerpt? And if it is not that useful, then why not boil it and other similar cases down into a sentence or two? This casebook was truly absolutely unhelpful and but for First Amendment nutshell and Understanding the First Amendment, I would not have survived the class or learned much of anything. Professors please do not pick this casebook.

Editorial Review:

Sullivan and Gunther’s First Amendment Law included important recent developments in areas such as the regulation of sexually indecent speech on the Internet and other new communications media, the constitutional law of political money and campaign finance, the government’s constitutional leeway to regulate liquor and tobacco advertising, the constitutionality of decency restriction on national arts grants, and the use of public funds to subsidize parochial school education. One volume.

For those serious about producing 4 out of 5 stars.
2 of 2 people found this review helpful.

Good basic legal information oriented towards the independent feature film producer but useful for anyone who wants to produce film or other distributed video. Won't replace having an attorney but will allow you to do some things by yourself and understand what is going on when you need to hire one. Similar to "The Independent Film Producer's Survival Guide" but with enough distinct material (example contracts for instance) to be worth having both.

Editorial Review:

This invaluable collection of sample entertainment contracts and discussions of the terms and concepts contained therein has been expanded in this second edition by the addition of twenty new contracts, bringing the total number of contracts to sixty. Includes contracts covering: depiction -- release, option, purchase; literary submission and sale -- release, option, purchase; artist employment -- writer, director, actor; Collaboration -- writer, joint venture, co-production; music -- television rights license, soundtrack, composer; financing -- finder, limited prospectus; production -- line producer, casting director, crew, services, location; distribution -- theatrical, merchandising -- product release, license; retainer -- agent, attorney; and much more.
