The United States Supreme Court famously labeled copyright "the engine of free expression" because it provides a vital economic incentive for much of the literature, commentary, music, art, and film that makes up our public discourse. Yet today's copyright law also does the opposite--it is often used to quash news reporting, political commentary, church dissent, historical scholarship, cultural critique, and artistic expression.
In Copyright's Paradox, Neil Weinstock Netanel explores the tensions between copyright law and free speech, revealing how copyright can impose unacceptable burdens on expression. Netanel provides concrete illustrations of how copyright often prevents speakers from effectively conveying their message, tracing this conflict across both traditional and digital media and considering current controversies such as the remix and copying culture rampant on YouTube and MySpace, hip-hop music and digital sampling, and the Google Book Search litigation. The author juxtaposes the dramatic expansion of copyright holders' proprietary control against the individual's newly found ability to digitally cut, paste, edit, remix, and distribute sound recordings, movies, TV programs, graphics, and texts the world over. He tests whether, in light of these developments and others, copyright still serves as a vital engine of free expression and he assesses how copyright does--and does not--burden speech. Taking First Amendment values as his lodestar, Netanel argues that copyright should be limited to how it can best promote robust debate and expressive diversity, and he presents a blueprint for how that can be accomplished.
Copyright and free speech will always stand in some tension. But there are ways in which copyright can continue to serve as an engine of free expression while leaving ample room for speakers to build on copyrighted works to convey their message, express their personal commitments, and create new art. This is a great book full of clever, easy party ideas. Every detail is covered, from invitation design to seating arrangements to games and entertainment ideas. The recipes are simple yet sophisticated. Can't wait to use it!

This is a good guide for introducing someone to the subject. Like the title says, it's the essentials, giving the reader a foundation to come back to wherever the particulars of their situation might take them. It is a big plus that the book is surprisingly readable - Important given that the typical reader might have to read the book in order to develop an understanding of why they should have an interest in the subject.

This book was a quick read yet chock full of important information about licensing. Even though i already work in the licensing industry, this book offered specific knowledge of contract terminology and negotiation strategy that i found useful.

This is a great summary of the essentials of Intellectual Property licensing. Even for attorneys, this is very useful because it takes several years in practice to encounter this many situations and solutions the book has described. I particularly liked the chapters on Licensing Strategies: the carrot and the stick, Royalties and Royalty Rates, and Negotiating the Deal. The Checklist of Patent License Terms is a very useful tool to daily practitioners of patent licensing. This book combines IP law with its unique business environment and suggests those unique strategies and practices. Recommend for junior to mid level IP attorneys, contracts professionals, paralegals, and licensing professionals. Great playbook on licensing.

The third edition is up to date--It is super!!! 5 out of 5 stars.

I don't know whether or why the 2d edition would be on sale, as the first reviewer implies in his or her nevertheless good review. The third edition has been out for two years and it is complete, accessible, understandable, and better than the competition--by far! If you want to understand patents, copyrights, trademarks, this book will make you an expert in an afternoon.

I only read the patent section, and have no knowledge of the other sections. However I have found the book to be entirely too superficial to be of any assistance. Additionally, at more than one occasion on topics that are fairly important, the information was just wrong. I have read the patent section of my IP supplements to prepare for the exam, and I by far recommend the IP hornbook. It's a little longer but WAY worth it over this book. If your library doesn't have a copy and it's too expensive for you, then try Examples and Explanations, but whatever you do, don't just rely on this book, you'll look like an idiot when you completely misstate some things. I mean 90 to 95% of it is right, I'm sure, but I'm going to get enough wrong on my own, I don't need help.

A great book for anyone interested in U.S. mass communication law, covering topics such as First Amendment guarantees, libel and slander in mass communication, privacy, obscenity, freedom of the press, commercial speech and FCC regulation of mass media, explained through U.S. Supreme Court decisions (v.g., New York Times Co. v. Sullivan, Miller v. California, New York Times Co. v. United States). Specially interesting is the discussion about content restraint of motion pictures (chapter IV) and TV (chapter XI), the latter an issue back on newspapers after a recent Supreme Court decision (United States v. Playboy Entertainment Group, Inc.).

It's not the newest version of this book since at the time I got it Amazon wasn't carrying it, but it was still very helpful and concise.

This book is full of typos and misspelled words. Most of the ideals are very vague.
