Contracts by Schaber 5 out of 5 stars.
9 of 10 people found this review helpful.

The book has an excellent presentation of the theory of contracts. The six main categories are described initially and explained in the ensuing text. These categories consist of:
1. Express contracts consisting of the standard offer-acceptance
and consideration trilogy
2. Implied in fact contracts distinguished by conduct rather than
by express words
3. Promissory estoppel referred to as detrimental reliance
4. Subsequent promises to perform pre-existing obligations
5. A minority theory of imposing liability based upon a subsequent promise to pay for material benefits previously conferred.
6. Implied in law quasi-contracts which are non-consensual obligations

The theory of an offer arouses an expectation in the mind of a
reasonable person. Such an expectation may create a power of
acceptance in the offeree. An offer must be sufficiently certain
to make any resulting agreement enforceable and damages calculable. The offer must be certain as to the parties, subject matter, price and time of performance. An offer in which the
offeror or offering party promises to do or not to do something in exchange for a promise by the offeree to act is an offer for
a bilateral or two-sided contract. Further details as to
bargained exchanges, the statute of frauds and a whole host
of complicating factors are set forth simply with a generous
sprinkling of stare decisis cases to illustrate the legal
points explained. The text will be helpful for law students, journalists, constitutional scholars and a whole host of
other constituencies in academe.

This text is a good supplement to the standard legal texts on contract law. It is well worth the price charged.

Editorial Review:

Rohwer and Skrocki's Contracts in a Nutshell is a succinct summary of the fundamentals of contracts. Contains expert coverage on forming contracts, restitution, statute of frauds, contract interpretation, and modification. Also discusses remedies, performance, and third-party beneficiaries.

West's Business Law Alternate Edition 5 out of 5 stars.

The product in itself was exactly what I needed. I am taking a Business Law class as part of my curriculum in Business Administration. I have found the the book is very informative but a little dry in reading. I was pleased with the speed of how the product was shipped but displeased in the condition it arrived in for part of the binding was literally cut down the bottom. It hasn't caused any issues for use but I know I will not be able to sell the book back to anyone without losing half of what I paid for it. My advice is to be aware of what you are buying and make sure that you ask the right questions. This was my first item bought off Amazon and it was much needed for class becuase the bookstore ran out and would be a while before getting any in so really there was little to no room for argument with the vendor. Anyway make sure you ask question and be aware that New does not always mean New!!!!!

Good, but look at Common Sense Rules of Advocacy by Evans 4 out of 5 stars.
10 of 25 people found this review helpful.

Mauet's book is very good, but Keith Evans' book, Common Sense Rules of Advocacy for Lawyers, IS FOR THE ADVOCATE AND NOT THE LITIGATOR.

Keith Evans practiced as a trial lawyer in California and as a barrister in England. In addition to law school teaching, Mr. Evans also made numerous presentations to different American Inns of Court.

Evans book is now published by TheCapitol.Net, and more information about this classic of trial advocacy can be found on their web site: thecapitol.net

Best bet is to buy Mauet's book and also the Common Sense Rules of Advocacy for Lawyers by Keith Evans.

A classic, but there are better books on trial techniques out there 3 out of 5 stars.
10 of 10 people found this review helpful.

Mauet's book has been around for a long time and it's beginning to show its age. The new edition sticks with the same format and doesn't add much new material. It offers solid advice that hardly anyone would disagree with, but in fact that's one of its flaws: it just doesn't push the envelope. For example, it tries to teach trial skills by looking only at hypothetical situations and fictional characters. Why use fiction when real life is so much more interesting and instructive? Why not use real court cases and learn from the mistakes and successes of lawyers we all know about?

My favorite trial techniques book right now is Winning at Trial, written by a current US Attorney (D. Shane Read). The author not only knows what he's talking about (you get the same solid advice as with Mauet), but the book also comes with two DVDs with over 4 hours of video from televised trials (including the O.J. trial), as well as numerous transcripts from actual trials. For students, your professor is probably going to stick with whatever text they're currently using, but I would recommend Read's book as a complement to give you a better idea of what really good (and not so good) trial attorneys do in actual trials.

Goofy Things Said in Court 5 out of 5 stars.
11 of 11 people found this review helpful.

The book is a collection of things people actually said in court, word for word, taken down by court reporters. It must be tough to record some of these exchanges without laughing out loud. Fun reading for anyone, but if you have a friend who's a lawyer or a judge, it might be the perfect gift for them.

Here are some samples from the book:

ATTORNEY: What is your date of birth?
WITNESS: July 18th.
ATTORNEY: What year?
WITNESS: Every year.
_____________________________________

ATTORNEY: How old is your son, the one living with you?
WITNESS: Thirty-eight or thirty-five, I can't remember which.
ATTORNEY: How long has he lived with you?
WITNESS: Forty-five years.
_____________________________________
ATTORNEY: What was the first thing your husband
said to you that morning?
WITNESS: He said, "Where am I, Cathy?"
ATTORNEY: And why did that upset you?
WITNESS: My name is Susan.
______________________________________
ATTORNEY: Now doctor, isn't it true that when a
person dies in his sleep, he doesn't know about it until the next morning?
WITNESS: Did you actually pass the bar exam?
____________________________________
ATTORNEY: The youngest son, the twenty-one-year-old, how old is he?
WITNESS: Uh, he's twenty-one
________________________________________
ATTORNEY: Were you present when your picture was taken?
WITNESS: Would you repeat the question?
______________________________________
ATTORNEY: So the date of conception (of the baby)
was August 8th?
WITNESS: Yes.
ATTORNEY: And what were you doing at that time?
WITNESS: Uh....
______________________________________
ATTORNEY: She had three children, right?
WITNESS: Yes.
ATTORNEY: How many were boys?
WITNESS: None.
ATTORNEY: Were there any girls?
______________________________________
ATTORNEY: How was your first marriage terminated?
WITNESS: By death.
ATTORNEY: And by whose death was it terminated?

Editorial Review:

Sit back and enjoy a collection of verbatim exchanges from the halls of justice, where defendants and plaintiffs, lawyers and witnesses, juries and judges, collide to produce memorably insane comedy.

Editorial Review:

“A masterful examination of the pathetic rush to judgment in the Duke rape case.” —John Grisham

The full story of the Duke Lacrosse case, by the authors who broke it

In this American tragedy, Stuart Taylor, Jr., and KC Johnson argue, law enforcement, a campaigning prosecutor, biased journalists, and left-leaning academics repeatedly refused to pursue the truth while scapegoats were made of these young men, recklessly tarnishing their lives.
Until Proven Innocent is the only book that covers all five aspects of the case (personal, legal, academic, political, and media) in a comprehensive fashion.  It is also the only book to include interviews with all three of the defendants, their families, and their legal teams. And now it includes an up-to-date epilogue detailing the aftershocks and conclusion of the case.
Taylor and Johnson’s coverage of the Duke case was the earliest, most honest, and most comprehensive in the country, and here they take on the idiocies and dishonesty of right- and left-wingers alike, shedding new light on the danger of a cultural tendency toward media-fueled travesties of justice. The context of the Duke case has vast import, and in its full telling, it is captivating nonfiction with broad political, racial, and cultural relevance to our times.

“Taylor and Johnson have made a gripping contribution to the literature of the wrongly accused.” —The New York Times Book Review

Until Proven Innocent is a stunning book.” —The Wall Street Journal

“Vivid, at times chilling . . . their most biting scorn is aimed at the ‘academic McCarthyism’ that they say has infected top-rate American universities like Duke.” —Newsweek

“A superb new book . . . a book that not only reads like a legal thriller, but also exposes deep problems with America’s legal system and academic culture.” —The Economist

(4th ed.) Good overview/foundation for further research 4 out of 5 stars.
3 of 4 people found this review helpful.

The most difficult thing about studying any body of laws resides, not in its substance, but in its presentation. One advantage of immigration law is that it relies heavily on fairly stable categories. This book should help anyone but the most impatient to build a first outline of the main categories of immigration law--with helpful annotations.

15 chapters: 1-4 (background information--including history and constitutional law); 5 (immigrant visas), 6 (nonimmigrant visas), 7 (zooms on student visas--a sub-category of nonimmigrant visas), 8 (removal--formerly "deportation"), 9 (inadmissibility), 10 (refugees/asyless), 11 (international law), 12 (citizenship), 13 (zooms on rights of aliens in general), 14 (criminal aspects of immigration law), 15 (ethical practice).

My main advice is to take good note of the general INA and CFR provisions under each category and subcategory, and names (and holdings, why not) of important cases. Add that to your outline, and you have a fine guide for further research. In other words, if your goal is to familiarize yourself with the field AS A WHOLE for the first time, don't get bogged down in the discussions of legal history and cases at first (yes, this is not a manual, so what's the point?)--except for the general history of US immigration law at the start of the book, which gives you a good first sense of the "spirit" of US immigration policy. You could come back to those discussions later, without the aggravation.

I do not recommend delving directly into any body of laws that is as extensive as immigration law, unless of course you have a few years to spare--but then again why waste that time? Think of books like this one as you would of maps: you don't want to have to start looking for California, street by street, starting in Washington DC. The point is this: an overview is always useful. This one should help you, if you use it properly.

Editorial Review:

This compact, comprehensive title offers an expert overview of the history, source, and structure of immigration law. Visa standards, deportation and exclusion issues, refugee and asylum issues, citizenship, and the rights of aliens are also discussed.

Overall, I recommend it. 4 out of 5 stars.
6 of 6 people found this review helpful.

This book was assigned to one of my MBA classes. The book itself was a good source of reference not only for my business law class but also to other two classes. The book's language is simple and easy to understand. The only flaw I found about this this book was that some cases were complex and I had to refer to actual law books and regulations. Overall, I recommend this book.

Editorial Review:

This highly effective text provides superior legal, ethical, and regulatory coverage while fully integrating practical business practices for tomorrow's business managers. Legal topics are explored and explained through real-world business examples (over 300 references to business are made in the text). In addition to a solid foundation in the law, students learn valuable legal and ethical reasoning skills through a variety of critical thinking exercises. Readers receive -- and appreciate -- practical advice on when it is necessary to call a lawyer, how best to use legal aid services and how to avoid legal trouble in the first place. This text fulfills current curricular and AACSB accrediting standards.
