Court cases are never as quick and tidy as television dramas would have us believe. In fact, most civil disputes are settled long before a judge has a chance to pound a gavel. That's why pretrial fact-finding procedures such as depositions play an increasingly important role in legal quarrels. In fact, it's not uncommon for a deposition to be the only testimony given. All of this explains why Nolo's Deposition Handbook can be such a useful resource. For the uninitiated, depositions are the process that enable either party in a lawsuit to question the other, as well as other witnesses, under oath before a trial begins. To prepare readers, authors (and attorneys) Paul Bergman and Albert Moore do a commendable job of dealing with real-life issues, such as what to do--and not to do--in preparation for a deposition, what to do if you're asked to bring documents to a deposition, how far you can be required to travel, and how to deal with trick questions that many lawyers love to ask. Three "Golden Rules" are also offered to help people through the deposition process. Put simply, the rules are to listen to the entire question and then answer only that question; answer truthfully and completely; and if you don't understand a question, don't answer it. The tone of the entire book acknowledges--without being condescending--that legal arenas are an area where novices feel quite underqualified. For example, the authors warn against engaging in seemingly harmless chit-chat with a companion before and during breaks in a deposition. The reason is one that most non-lawyers would be hard-pressed to imagine: Deposing counsel can ask the companion to reveal what the deponent said. Of course, readers intrigued by that line of thinking will thoroughly enjoy the last half of the book, which is devoted to those interested in representing themselves in legal matters. --John Russell

Terrific Book on Oral Advocacy 5 out of 5 stars.

In order to prepare for oral argument in an important federal appeal, I ordered numerous books on oral advocacy. This book may be "little," but it was actually the best of the five books that I read. (Second best was "Winning on Appeal" by Judge Ruggero J. Aldisert). It was somewhat surprising that this book was best, because it was the smallest of the lot and, to some degree, is geared toward law students participating in moot court competitions, rather than to practicing lawyers. But this book had the most practical suggestions and I skipped over the parts applicable to moot court competitions (coordinating argument with a partner, etc.) I also liked the fact that this book had practical suggestions about dealing with "stage fright." Some of the other books I read suggested that if you don't feel totally comfortable with public speaking, perhaps you should find someone else to argue your appeal (gee, thanks). This is the book that I read over again the night before oral argument, and its upbeat tone and concrete suggestions really calmed my nerves. I highly recommend this book to any lawyer preparing for oral argument or for any law student participating in moot court.

A MUST --Makes the difficult areas of Cross-Examination easy 5 out of 5 stars.

This is the third installment. In plain language, the author tackles many difficult cross-examination issues. The author uses easy to understand examples to illustrate complex litigation processes and skills that the expert witness must master before taking the stand. As a lawyer, I highly recommend this book to anyone interested in expert testimony. I give this book my highest rating. Also, check out the other two books on expert testimony by the author.

I have just finished reading Stanley Brodsky's Coping With Cross Examination. I absorbed it like a sponge. Although most of the book is devoted to testimony by mental health experts in criminal court, there is much in the book that is very relevant in other contexts. I have rarely been asked or required to testify in criminal cases, but I have provided expert medical testimony at hundreds of Social Security disability appeals hearings, complete with judge and lawyer. In that role there is often conflicting evidence and the expert must integrate all of the relevant evidence, and most importantly be prepared, professional, impartial, and provide relevant understandable testimony. Dr Brodsky's book clearly speaks to those points. The book is full of good examples, good humor, and good reasoning. It is the kind of book that I am likely to consult again to help me in my work. I highly recommend this book to any mental health professional who may be asked to provide sworn testimony. I also recommend it to those who may not testify but who may be retained by lawyers for evaluations or consultations. Dr. Brodsky's ethics are superb. This book is a very practical and helpful guide to working with lawyers and judges.

If you want a quick, easy-to-follow introduction to the deposition process, this book does a very good job of that. I've recommended it to many of my clients, and they all found it to be a great primer for helping them understand what happens at depositions. The book even offers some strategies for helping witnesses get through cross-examination. It's compact enough to read in a day, yet the information it contains is so on point that it completely demystifies the entire deposition procedure. Its numerous examples and sample transcript make it a good bet for anyone having to give a deposition.

This guide is a relatively small, spiral bound, 87 page pamphlet. It contains much useful information about what happens at a depostion, how to prepare yourself for a deposition, and answering the questions you will get at a deposition. It seems designed as an introductory guide for those who are either representing themselves or for those whose attorneys have not spent enough time explaining the process to them. This booklet should help calm your fears about the process. This guide is short enough that you can easily read it in an evening. It is written in plain English without the legal jargon. The author is a court reporter, not an attorney, but she clearly communicates a lot of basic information you need before going into a deposition.

This does at it says, but is not the best piece of explanation of brief writing. It was requrired for class. I got the best deal here at Amazon.
