Other law students assume you have read this book 4 out of 5 stars.
0 of 0 people found this review helpful.

I hear references to this book all the time in the halls of my law school and on fellow student's face book message boards. I do not go to a top tier law school like the author (he went to Harvard). I also have a different background than the author and our political views are not similar.

Nonetheless, this book does relate a lot of the experiences and attitudes a law student can expect to run across during the first year. The overly aggressive professor, the students who have a problem with those who succeed, the students who do not know how to succeed but annoy everyone with their efforts, the students who panic, the students who mooch, and the ever present fear that no person could ever master the amount of information a law student is expected to know by the time of the final...but someone will and they will push down the curve. Every law student has run across these types of people and experiences.

I do not think law school is as hard or stressful as the author seems to think it was. I am not sure he played up that aspect of the school for dramatic effect, he just can't handle stress, or life at Harvard Law School is really just that much more intense than my own. Still, reading this book gives a prospective student a taste of what is to come.

The book is very readable and I finished it quickly; however, it is not a classic I would recomend to everyone. I am not sure a person who has no interest in going to law school will really be that excited about reading "One L," but if you are thinking about going to law school, you should read this book.

Editorial Review:

Becoming a first-year law student—a "One L"—at the oldest, most esteemed law school in the United States threw Scott Turow into a physical, emotional, and intellectual combat zone. An ultimate test by fire of his own honesty and principles, it was a time of hazings, betrayals, challenges, and triumphs. Here, in national bestseller, law school primer, and classic autobiographical account, the author of Presumed Innocent reveals the shocking, fascinating reality of a first year at Harvard Law School—and what life is like for a typical...One L.

S. Supreme Court in 'Florence County School District IV v. Shannon Carter, 510 U.S. 7 - 1993 in which he won a landmark victory for all children with disabilities) and Pam Wright (a psychotherapist who has worked with children since the 1970s and is the Editor of 'The Special ed Advocate' newsletter), "Wrightslaw: Special Education Law" addresses the issues of a child's right to a free and appropriate education; individualized education programs, IEP teams, transition and progress; evaluations, re-evaluations, consent and independent educational evaluations; eligibility and placement decisions; least restrictive environment, mainstreaming and inclusion; research based instruction, discrepancy formulas and response to intervention; discipline, suspensions and expulsions; safeguards; mediation, confidentiality, new procedures and timelines for due process hearings. A critically important addition to school district and community library Educational Laws & Guidelines reference shelves, "Wrightslaw: Special Education Law" should be considered 'must reading' for anyone (but most especially by parents and school authorities) charged with the responsibility for educating a disabled child regardless of the nature or degree of the disability.

Hamdan vs. Rumsfeld 5 out of 5 stars.
11 of 11 people found this review helpful.

Here is an astonishing story in which two unlikely and oddly paired attorneys (read heroes) take on the United States government on behalf of a Yemeni citizen detained at Guantanamo. Neither Lt. Cmdr. Charles Swift, the navy lawyer assigned to the case, nor Neal Katyal, the Georgetown law professor who volunteered to help, could have imagined where the case would take them nor what it would require of their careers, family, and personal well being. But the story of what they did, how they did it, what it took, who helped, and how it all came out is as amazing as it is important, resulting in one of the most significant legal decisions of the post 9/11 era, the Supreme Court's ruling on Hamdan Against Rumsfeld. Jonathan Mahler relates the tangled and extraordinarily complex sequence of events and legal maneuvers with such mastery of the material, you have to believe he had a degree in law was on hand for every conversation, discussion, and encounter. The Challenge is a gratifying David and Goliath story, but its real worth lies in the issues of justice and constitutionality which this case brings to the fore and which determine whether anyone will receive the justice presumably guaranteed by our constitution and international law.

Editorial Review:

A legal thriller in the spirit of A Civil Action and set against the backdrop of the war on terror, Hamdan v. Rumsfeld is the true inside story of perhaps the most important decision on presidential powerand of a brave lawyer who risked his career for justice.

    Editorial Review:

With an estimated 76 million baby boomers reaching the age of 65 between 2011 and 2029 -- and 40% of them needing nursing home care for either themselves or their parents -- there will be an overwhelming number of people seeking nursing home Medicaid: the only government program that currently pays for such care. If you have an elderly parent or other family member headed for a nursing home -- or already in a nursing home -- you simply cannot afford to be without this book.

Most people do not realize it, but the federal Medicaid program pays for over 50% of all nursing home residents, and you do NOT have to be broke to qualify! However, you DO have to understand the rules.

The author of this book has spent his entire 23-year legal career helping people qualify for nursing home Medicaid, in addition to other estate planning work. It is the definitive guide to nursing home Medicaid qualification and is the only resource that is completely up-to-date. It includes all the massive changes brought about by the federal Deficit Reduction Act that was signed into law on February 8, 2006 and later amended on December 20, 2006. That law changed many of the "rules of the game" -- including the rules affecting qualification for the Medicaid program.

Any one of the powerful techniques or secrets that are revealed in Medicaid Secrets has the potential to save you tens of thousands -- even hundreds of thousands -- of dollars in nursing home costs. The book will easily pay for itself over and over again for months or years to come. Medicaid Secrets is not available in bookstores.

Includes a summary of all income and asset rules for both married and single individuals, together with numerous examples and several case studies¿which take you inside the mind of an experienced elder law attorney as he analyzes real-world client situations, goes through a checklist of options, and makes his recommendations. This section alone is worth the price of the book!

Not for laymen, indeed 5 out of 5 stars.
6 of 7 people found this review helpful.

Disregard reviews criticizing the technical nature of this book. I became a fond user of the Nutshell series when I was in law school; I don't think that these books were ever intended for use by the Average Joe. By its very nature, the subject matter is technical and can only be simplified so much. There is a reason why there is no such book as "International Taxation for Dummies" or "Brain Surgery for Dummies".

These books are great to use as a springboard for further research and study of the issues covered. I would recommend the book to students and practitioners of accounting, business, and taxation.

    Editorial Review:

This Nutshell provides the fundamentals of U.S. international taxation. Addresses the U.S. activities of foreign taxpayers, as well as the foreign activities of U.S. citizens and residents, focusing on the U.S. foreign tax credit. Special U.S. international tax provisions creating incentives or disincentives for certain conduct or forms of business transactions are featured.

    2005 Edition

The Special Needs Trust Administration Manual is an invaluable guide for anyone who is managing a Special Needs Trust for a person with disabilities.

The authors, who are all Massachusetts attorneys, bring many years experience in guiding trustees through the complicated rules of Special Needs Trusts. In clear and easy to understand language, the authors explain how a trustee can use trust funds to meet the financial needs of a person with disabilities while complying with the complex rules of government benefit programs. The Special Needs Trust Administration Manual covers a multitude of topics, including what trustees need to know about:

    • Public benefit programs such as SSI, SSDI, Medicare, and Medicaid
    • Taxes and Special Needs Trusts
    • Payment of recreation, transportation, and medical costs
    • Housing subsidies
    • Trustee duties

The Special Needs Trust Administration Manual is a useful resource for anyone who wants to know more about disability trusts and public benefits.

A Must Read for Teachers 5 out of 5 stars.
11 of 12 people found this review helpful.

Case law, unless done perhaps by the likes of John Grissam, is not page turning material. However, the authors have done an incredible job of putting very pressing and often complex areas into an accessible and engaging book. Written in an easy to use question and answer format, the updated book touches on education legal issues ranging from free speech, to students with disabilities, to internet issues. While of great use for educator (or educators to be), the book could also easily be adapted for classroom use, either as a debate or research starter. Worth every penny of its price.

Excellent resource, but guidance was helpful 4 out of 5 stars.

Teachers and the Law (6th Edition) was the primary text used for my National-Louis University (Wheeling, IL) School Law course. Although the text implies that only information regarding teachers will be discussed, Fischer actually covers legal issues that deal with many levels of educational law including student cases, administrator cases, and even cases that don't involve teachers at all, but loosely relate to educational law in general.

This was my first exposure to any formally-presented school law information and I must confess that I was quite overwhelmed at first. Fischer tends to present a major case very clearly and then fully explains its implications and outcomes. However, he then presents several other related cases that often have conflicting or opposing outcomes to the original point.

What I learned from this text is that there is very little "black and white" when it comes to interpreting school law. I was interested to learn that even the landmark decision cases are still constantly debated in the courts and sometimes ignored when decisions are made by judges or juries. It took our experienced professor to help us understand the subtext of some of the cases and discern the probable reasons why some cases were decided in seemingly arbitrary ways.

In general, Teachers and the Law greatly increased my understanding of school law, but without an experienced professor, I would not have gleaned as much practical information.

A superb reference for aviation professionals & hobbiests. 5 out of 5 stars.
3 of 3 people found this review helpful.

Now in a completed updated, revised and expanded second edition, Scott Hamilton's Practical Aviation Law provides complete, competent course for self-study or undergraduate study on how the legal system works with respect to aviation activities. With entertaining examples of aviation law in action, all of the recent changes to date in statutory and regulatory law are clarified, including international law. Practical Aviation Law is soundly recommended as a quick reference guide for aviation managers, private and professional aviators, flight cres, airline personnel, aircraft owners, air traffic controllers, air safety investigators, and the non-specialist general reader involved in aviation as a profession or hobby.

If you hold an FAA certificate -- you need this book! 5 out of 5 stars.

Several years ago, while attending Emery-Riddle Aeronautical University, this book was used as our textbook for Aviation Law. To this day, anytime I get on the subject of Aviation Law, I recommend this book to anyone who holds an FAA certificate. I'm a Maintenance Supervisor for a major airline and have suggested it to my employees who have found themselves in less than desirable situations involving enforcement actions. They always come back to me with the same comment; "I wish I had read this book before I got into trouble." Learn from their mistakes - read the book before you NEED the book. It's short and to the point, you won't be sorry!

    Editorial Review:

Lists basic legal concepts of American aviation and how they can be applied to everyday aviation-related situations.
